Thank you for your review and comment on the permit application for the above mentioned
project. We greatly appreciate your willingness to work with us on this project in light of the fact
that it has such a unique set of circumstances on site.
Tory Taylor, the contractor, met with the adjoining property owners and came up with the
following responses to constructing our new building on the property lines. Mike Bingham, with
Bingham Furniture has been most cooperative and has allowed me, our structural engineers and
Tory Taylor, full access to the ulterior of their building to investigate any issues that we needed
to address with our design and construction. We have designed our foundation and walls to
accommodate existing conditions and constructing adjacent to such an old unreinforced masonry
structure. When Tory met with John Van Norman, building owner to the south, he wa not met
with such agreement. Tory approached Mr. Van Norman about the issue of noncompliant
windows on the south side of the Great Harvest Bread Company building and how we can meet
with mutual agreement, he was told that he wanted compensation for the loss of the window and
that we would also need to pay for the construction in his building. Other options were
discussed; however, it became apparent that Mr. Van Norman doesn't want to remove the
openings and the more difficult he could make the solution, the less we might want to pursue it.
We have made every reasonable effort to design a building that is code compliant_ We have been
reasonable with Mr. Van Norman, we respectfully that the permit be released and our framing
proceed. We propose to construct a window well at each of the two windows along the south
wall of our building to provide daylight to Mr. Van Norman's building. However, to provide to
most compliance, Mr. Van Norman will need to replace the windows with a fire rated glass and
frame. Under the circumstances this is the best we can comply with the code.
