On August 10, 2a07, Schiess & Associates presented to the Rexburg Planning & parsing Coordinator a Recluest and Applicatl'on for a Preliminary Play fax Silver Estates. CI TY 0 E )-W.URG 2- On September G, 2007, Kurt Roland presented to the Rexburg Planiu-ng & Zoning Col-ninission the bequest for appxoval of the Prehminar5r Platt for Silver Estates. The ConTrnissioners discussed the pkat. Maty Haley said she doesn't know hoer the plat can be approvo ed, since it doesn't line up With the grid system. Kutt Roland said he would like the City to reconsider the grid system on this piece of ground because if Nve put the road on the south end of the development, we cannot have development on both sides of the goad. The Commissioners discussed the issue. Mary Haley motioned to table the preliminary plat dor Silver Estates until the applicant can comer with the city= and get the further information we need. David Stein seconded the motion. None opposed. Motion carried. 3. On May 15, 2008.3 at the Rexburg Planning Sz Zonm'g meerin�, Thaine Robinson motioned to pick the Pte ' -LI.L*]-%atT Plat for Silver Estates up off the table. Ted Hill seconded the motion. 41 Noneopposed. Motion carried. The Commissioners discussed that there had not been any d.ICtiV1ty Yegardlt1,(,-Y, t1lis plat.. Ted Hill motioned to -recommend disapptoval of Silver Estates Ptcl,am itzry flat to GtyCouncil,, but to allow the applicant GO days to act an the plat .in ordex for the applicant to have credit dor application fees already paid, subject to staff approval i.e. Stephen ZoIlinger, the City Attorney,, and Richard FIarnex, the Chief Financial Officer of the City}. Dan. Hanna seconded the motion. None opposed. Motion Carried.. 4. On June 04, 2008 at City Council, CityAttorney ZoInger explained the Preliminar�- Pkat for Silver Estates had been tabled an the Plan ning and Zonm'g corrirmssion.'s agenda. The Cornrmssion removed it from the table and denied the application due to inactivity on the part of the developer. Ni�Iaycar Latsen explained the City Council needs to take action an this request to clear it off the agenda. The developer is planning to -resubmit the request by July 15, 200$. Planrm-ig and Looming recommended disapproval of Silver Estates Preliminary Plat, however, Council Member Stevens reminded the City Council the applicant would hay.e GO days Ouly 15, 2to act on the flat under the fees they already paid, Council Member Stout moved to deny the PreHmina�y� Plat for Silver Estates with the understanding the applicant could reapply with a near 1'relit1unarve Flat for Silver Estates under the same fee until July 15, X008; Council Member Mann seconded the motion; all voted aye, none apposed.
