WEATHERSTON being first duly sworn, depose and say, that I am the printer of THE STANDARD -JOURNAL, a semi- weekly newspaper printed and published semi-weekly at Rexburg, Madison County, Idaho; and I do solemnly swear that the NOTICE OF PUBLIC HEARING CITY REXBURG a copy of which notice appears attached hereto, was published in the regular and entire issue of said newspaper, and not in any supplement issue thereof for TWO consecutive issues, the first publication having been made on MAY 15, 1997 and the last publication having been made on MAY 29, 1997 Further, that said newspaper is one of general circulation in said county; that it is a legal newspaper, conforming to legal specifications under the Idaho Statutes; that it has at least two hundred bona fide subscribers living within the county of publication; and that it has been continuously and uninterruptedly published in said county during a period of seventy eight consecutive weeks prior to the first publication of the said notice. STATE OF I COUNTY OF MADISON T;iv 181997 0131 eT On this 30TH day of MAY in the year of 1997 , before me, a Notary Public, Personally appeared Terry Weatherston, known or identified to me to be the person whose name subscribed to the within instrument, and being by me first duly sworn, declared that the statements therein are true, and acknowledged to me that he ec ted the same, rnoua37y Aiic ror laano Residi g at Rexburg, Idaho My commission expires: May 21, 1999 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Tuesday, June 3, 1997, at 7 a.m., at the Rexburg City Hall, the City Council of Rexburg, Idaho, will hold a public hearing pertaining to the permanent closure and abandonment of the Street known as the "Old Salem Highway" as it runs from the Sugar City Highway to the current Salem Highway, between the Stockyards and the Veterinary Clinic, and more specifical- ly described as: Beginning at a point on the East right- of-way line of the Salem Road, said point being 33.0 feet East and North 0038'00" East 1,123.2 feet from the Southwest cor- ner of Section 17, Township 6 North, Range 40 East, Boise Meridian; thence running North 0038'00" East a distance of 179.0 feet; thence turning and running Southeasterly with a curve, said curve having a radius of 379.3 feet and a tangent bearing South 6035'00" East, a distance of 270.1 feet, more or less, to a point on the West right-of-way line of the Yellowstone Branch of the Union Pacific Railroad, said point being 1,066.6 feet North and 167.3 East of the said Southwest corner of Section 17; thence South 30040'00" West a distance of 61.3 feet; thence Northwesterly with a curve, said curve having a radius of 439.3 feet and a tangent bearing North 48049'00" West, a distance of 140.9 feet, more or less, to the point of beginning, containing approximately .259 acres. It is proposed that the property at issue, would be transferred to the property owners on either side adjacent to the por- tions abandoned in accordance with Idaho Code, Section 50-311. At that time the City Council will hear and consider any and all protests against or comments in favor of the abandonment of said properties. DATED this 15th day of May, 1997.
