WEATHERSTON being first duly sworn, depose and say, that I am the printer of THE STANDARD -JOURNAL, a semi- weekly newspaper printed and published semi-weekly at Rexburg, Madison County, Idaho; and I do solemnly swear that the NOTICE OF PUBLIC HEARING CITY OF REXBURG a copy of which notice appears attached hereto, was published in the regular and entire issue of said newspaper, and not in any supplement issue thereof for TWO consecutive issues, the first publication having been made on JULY 1ST 1997 and the last publication having been made on JULY 15, 1997 Further, that said newspaper is one of general circulation in said county; that it is a legal newspaper, conforming to legal specifications under the Idaho Statutes; that it has at least two hundred bona fide subscribers living within the county of publication; and that it has been continuously and uninterruptedly published in said county during a period of seventy eight consecutive weeks prior to the first publication of the said notice. / , I// In i.. _ A/� I D AUG 2 0 199) STATE OF COUNTY OF MADISON 018861 On this 16TH day of JULY in the year of 1997, before me, a Notary Public, Personally appeared Terry Weatherston, known or identified to me to be the person whose name subscribed to the within instrument, and being by me first duly sworn, declared that the statements therein are true, and acknowledged to me that h xe ted the she. ,, Notjr'y `'Yuniic Lor .uaano Residing at Rexburg, Idaho My commission expires: May 21, 1999 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Wednesday, July 16, 1997, at 8 p.m., at the Rexburg City Hall, the City Council of Rexburg, Idaho, will hold a public hearing pertaining to the amendment of the Com- prehensive Plan pertaining to, the follow- ing described property' Parcel 1 A tract of land in the west 1/2 of Section 36, Township 6 North, Range. 39 East, Boise Meridian, Madison County, Idaho, beginning at the southwest corner of See` tion 36, North 89053'15" East 1,314.41 feet along the south line of Section 36, to the south 1/16 corner of the southwest quarter of Section 36, thence north 00023'08" west, 2,004.98 feet along the said 1/16 line to the east right of way line of Highway 20-191; Thence along the east right of way north 22039'47" east, 43,76 feet continuing along said right of way line north 20054'09" east, 14.73 feet to the true point of beginning. The next (4) courses being along the east right of way line of Highway 20-191, (1) north 20054'09" East, 596.73 feet (2) South 89058'27" east, 227.14 feet (3) along a curve to the right a distance of 476.69 feet, radius 904.93 feet through a central angle of 30010'55" (chord south 74057'23" east, 471.20 feet) (4) south 59027'43" East 59.02 feet to the west right of way line of the Union Pacific Railroad; thence along the west right of way line of said railroad, south 30009'09" west, 547.01 teel; thence leaving said railroad right of way, north 59050'51" west, 336.08 feet; thence south 7§°Q9'09" west, 393.70 feet to the true point of beginning, containing appPdx- imately 8.55 acres, more or less. Parcel 2 A tract of land in the west +/2 of Section 36, Township 6 North, Range 39 East, Boise Meridian, Madison County, Idaho, bounded by South Highway 191 on the east side, Highway 20 on the west side, 1,500 south on the north side, and the southerly edge of the Rexburg Impact Area on the south side, less parcel 1 above. At that time the City Council will hear and consider any and all protests against the amendment to the Comprehensive Plan, said amendment proposing to change Parcel 2 above to reflect Industrial Use, and Parcel 1 to reflect Highway Business District Use.
