HomeMy WebLinkAboutOrd 1257 Rezone 525 E 7th N to MDR1 / ORDINANCE NO 1257 Rezone Approximately 525 East 7th North, Rexburg, Idaho to Medium Density Residential 1 (MDR1) AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed with the city clerk thereof, be, and the same is hereby amended and changed to provide that the hereinafter described property situated in the City of Rexburg, Madison County, State of Idaho, regarding (#21 00063) to rezone the property at approximately 525 East 7th North from Low Density Residential 2 (LDR2) to Medium Density Residential 1 (MDR1) zone in the City of Rexburg, Madison County, Idaho. The said property is located at approximately 525 East 7th North in Rexburg, Madison County, Idaho, and more particularly described as follows: Legal Description: Part of the South Half of the Southwest Quarter of Section 17, Township 6 North, Range 40 East, Boise Meridian, City of Rexburg, Madison County, Idaho, more particularly described as follows: Commencing at the Southwest Corner of said Section 17, thence N89°31'31"E 2341.63 feet along the South line of said Section 17 to the True Point of Beginning, thence leaving said South line along the extended boundary and boundary of Parcel 1 as shown on a Record of Survey by Dyer Group, LLC. having Inst. No. 323873 at the Madison County Recorder's Office the following three (3) courses; (1) N00°01'27"E 445.07 feet, (2) S89°32'07"W 421.62 feet to a point of a curvature to the left having a radius of 20.00 feet, a delta angle of 89°30'39" and a chord bearing S44°46'23"W 28.16 feet, (3) along said curve to the left 31.25 feet to a point at the East Right-of-Way of Stonebridge Street, thence leaving said Parcel 1 boundary along said East Right-of- Way N00°01'27"E 236.97 feet to the Northeast Corner of Centennial Townhomes Division No. 1 having Inst. No. 423222 at said Madison County Recorder's Office, said Northeast Corner also being at the boundary of said Record of Survey by Dyer Group, LLC., thence along said boundary the following three (3) courses; (1) N89°35'09"E 760.21 feet to the Northeast corner of said Record of Survey, (2) S00°08'13"E 661.47 feet to the South Quarter Corner of said Section 17, (3) S89°31'31"W 320.63 feet to the True Point of Beginning. Parcel contains 7.056 Acres. SECTION II: That a new zoning map showing these amendments shall be certified to and declared to be the official zoning map of the City of Rexburg by passage of this Ordinance by the City Council of the City of Rexburg. SECTION III: This ordinance shall become effective upon its passage, approval and publication.
