PROPERTY LOCATION: 20 S 12th W, RPR6N39E260006, RPR6N39E260007 COMPREHENSIVE PLAN: Commercial on E 12th W frontage; Low to Moderate Density Residential west of Commercial CURRENT ZONING: Low-Density Residential 2 (LDR2), Medium-Density Residential 2 (MDR2) & Community Business Center (CBC) PROPOSED ZONING: Medium-Density Residential 2 (MDR2) & Community Business Center (CBC) APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Zoning Map Revisions AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND This parcel is mostly agriculture ground. A home at 20 S 12th W has been moved from this property. These parcels were approved for annexation and considered 3rd Read at the July 5, 2017 City Council meeting (17-00211). The Rexburg Development Code allows the Commission to make recommendations to the City Council regarding whether or not the property should or should not be rezoned based on the criteria found in section §1.04.020. II. SITE DESCRIPTION The property is located just south of Mother Hibbards and west of Valley Wide subdivision. One parcel has the address 20 S 12th. The two adjacent parcels to the south and west are included in this rezone application. The total area for these lots is 22.804 acres, but the actual area of the lot being rezoned is 18.47 acres. ANALYSIS If approved the request will result in changing the zone for the parcels from Low-Density Residential 2 (LDR2), Medium-Density Residential 2 (MDR2) and Community Business Center (CBC) to eliminate the LDR2 zone and expand the areas for the MDR2 and CBC zones. The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. The Comprehensive Plan will be in conformance when the changes, currently proposed to the plan, have been approved by the governing bodies. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. The city has adequate capacities to service this request. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. The city has capacity to service this request. d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. N/A e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. Mother Hibbards at 15 N 12th W, north of this request was annexed into the city in 2020. Rexburg West Div. 1 Final Plat, Northeast of this request was approved in 2020. In 2016, Verizon put in a telecommunications tower south of parcel RPR6N39E260006. f. Meets the requirements of the Development Code. The request meets the requirements of the Development Code. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the change of 20 S 12th W, RPR6N39E260006, and RPR6N39E260007 from Low-Density Residential 2 (LDR2), Medium-Density Residential 2 (MDR2) and Community Business Center (CBC) to expand the Medium-Density Residential 2 (MDR2) and Community Business Center (CBC) zones if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
