I. BACKGROUND
The Rexburg Development code allows for the Commission to make recommendations to the City
Council regarding whether or not the property should or should not be rezoned based on the criteria
found in section §6.13. This property is currently zoned Rural Residential 2.
II. SITE DESCRIPTION
The total area involved in this re -zoning request is approximately 20.8 acres, which if approved will
result in changing a Rural Residential 2 zone into a High Density Residential 1 (HDRI) zone. The
surrounding area is Rural Residential 1 to the north, Low Density Residential 2 to the east and
Community Business Center (CBC) to the south. The east boundary is State Highway 20.
III. ANALYSIS
The request would require the Commission and Council to review the proposal against one set of
criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance 1026
(Development Code) that are required to be addressed, followed by staff's analysis of each criterion.
Criteria Rezone Requests 06.13):
a. Be in conformance with the City's Comprehensive Plan
The Preferred Land Use Map identifies the property as Moderate to High Density Residential.
Therefore the request is compliant with the Comprehensive Plan.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
The City Engineer is concerned "with the safety of the residents with serving 200 dwelling units
with only access through a parking lot" and that there is not sufficient snow storage. The City
Planner would remind the P&Z Commission that the request is for a zone change and that the final
outcome may or may not be as the plans provided unless the Commission request a "conditioned
approval".
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.
The City Engineer did not voice a concern. The appropriate Impact Fees will be collected prior to
the issuance of a Building Permit.
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.
Staff has reviewed and does not feel the change will have a negative effect. The Commission
should review the potential impact of added units.

e. Recent changes inland use on adjoining properties or in the neighborhood of the map revision.
There have not been any changes in land use on the neighboring parcels in the recent past.
Apartment units have been recently constructed and continue to be constructed a few hundred feet
to the north east of this property.
f. Meets the requirements of the Comprehensive Plan.
The Comprehensive Plan's Preferred Land Use Map identifies the parcel as Moderate to High
Density Residential. Therefore, the requirements are met.
IV. STAFF RECOMMENDATION
Staff proposes that the Planning and Zoning Commission recommend that City Council process the
requested zone change if the commission can determine that there will not be a negative impact to the
residential neighborhood to the north and that the concerns of the City Engineer are met.
