Main (PO Box 280) Rexburg, Idaho 83440 www.rexbura.ora Findings of Fact Conditional Use Permit Basement Apartment — 322 West 2nd North Phone: 208359-3020 x326 Fax: 208-359-3024 comdev aArexbura.oro On January 17, 2006, Dallin Howell presented to the Rexburg Planning & Zoning Permit Coordinator a Request and Application for a Conditional Use Permit located at 322 West 2"d North for a basement apartment. 2. On January 19, 2006, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for January 19, 2006 and January 28, 2006. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 3. On February 2, 2006, the Planning & Zoning Commission for the City of Rexburg granted the Conditional Use Permit. Commissioner Thaine Robinson moved to grant the CUP to Dallin Howell's basement apartment at 322 West 2"d North with the condition that the conditions are met in Section 6.13 Subsection B in the ordinance, and that they would meet the zoning requirements, notwithstanding what may be happening on surrounding properties in the neighborhood. Commissioner Michael Ricks seconded the motion. None opposed. Motion carried.
