NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the Planning &Zoning
Commission of the City of Rexburg, Idaho, Thursday, October 04, 2007, at 7:05 p.m., in the City
Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding a Variance
of the setback requirement for parking lot at the Madison School District Administration office at
290 North I" East. The parcel is zoned Community Business Center (CBC).
The said property is located at 290 North 1" East in Rexburg, Madison County, Idaho, and more
particularly described as follows:
Commencing at the Southwest comer of Lot 2, Block 16 of the Original Town site, as per the
recorded plat thereof, and running thence North 100 feet, thence East 125 feet; thence South 100
feet; thence West 125 feet to the point of beginning.
At such heating the Planning & Zoning Commission will hear all persons and all objections and
recommendations relative to such proposed permit. The City Clerk will also accept written
comments at City Hall prior to 4:00 p.m. on October 03, 2007.
This notice is given pursuant to the provisions of Section 67-6509 and 67-6511 Idaho Code, and all
amendments thereof

Nature of Request (Briefly explain the proposed use)
Expansion of existing Bus Parking to include 12 additional lighted secure parking spaces. We are requesting a
variance on the City Code # 926 requiring a 40 foot landscaped setback from the City right of way. We are
requesting a 28 foot landscaped setback to allow manoeuver room for buses. There will be no parking in this area.
The lot will be enclosed with a 6 foot aluminum or wrought iron fence. The setback will be landscaped with grass
between the sidewalk and road, and grass and shrubbery between the fence and the sidewalk. No new access is
being requested.

"e following conditions must be fulfilled before a variance can be granted by the Planning & Zoning Commission.

sufficient. Below each requirement explain why your request conforms:
1. The need for a variance results from physical circumstances of the property. Such circumstances generally
include size, shape, topography, location, or surroundings of the property and do not apply to other properties in
the same zone.
The property included in the variance is surrounded by District property. The District office is located to the north,
bus parking is located to the east and the property is buffered to the south by a residential structure converted to .
office use. Property across the City roadway to the west is empty lots and commercial storage with no setback from
the City right of way.
2. Failure to obtain a variance will result in undue hardship to the applicant.
Our district is, as is the City and County, growing rapidly. We have grown by 600 students in the last 5 years. We are
required by law to provide transportation for our students. We have added 10 additional buses in the last few years
and will be adding 2 more in 2008. We have no parking available for the buses we acquired this summer and they
need electrical outlets for engine heaters before this winter.
3. The alleged hardship has not been created by the action of the property owner or applicant, e.g. applicant did not
reduce size of lot by prior sale.
have managed to get by with out this lot expansion until now, due to dynamic growth this expansion is
cssary to provide transportation to the students of Rexburg and Madison County.
4. Approval of the variance will not be in conflict with the interest df the neighborhood or public interest in general.
Expansion of this lot has already improved the visual aspect of the neighborhood. We have completed sidewalks
and are converting a weed filled lot to a lighted, fenced area that will be well kept.. There is only commercial
property to the west, north and east of this lot. Only two residences are within view of this lot.
The Commission or Council may address other points than those discussed above, but a narrative addressing at
least those applicable points will assist in processing your application. A PLOT PLAN MUST BE ATTACHED IN
ORDER TO PROCESS THIS APPLICATION. Included on the plot plan setbacks, parking, etc.
Formal notice will be sent to applicant after approval of a Conditional Use Permit. Notice will state the conditions
of the permit. If conditions are violated or not met there will be 90 day period to cure the problem. Failure to
comply with the terms may result in revocation of the Conditional Use Permit. )

Dear Council Members,
October 3, 2007
In regards to a variance of the setback requirement for a parking lot at the Madison School District
Administration office, Let me lend my support to the school district.
As a close neighbor to this property, I feel leaving a space unpaved and unfenced would be a grave mistake.
In looking at the property and properties across the street and around the comer to the North and at Rays
and the former Beehive book store and the tax building next to Rays.. My Wife and I can see no problem
whatsoever with finishing the paving and putting a fence next to the sidewalk. As a matter of fact, it would
be a lot more cost effective than trying to water and care for an area that most certainly would be covered
with snow part of the year and weeds the rest. Lets face facts, Our tax money could best be put to use at the
schools rather than whatever the city is looking at by forcing a setback of the parking at the administration
offices. In fact might I suggest paving the area between the sidewalk and the curb also.

Development Standards Review
The Commission must make findings of fact
that satisfy the requirements for issuing a
variance, they are:
1) The need for a variance results from physical
limitations of the lot upon which the variance is
requested which are not generally applicable to
other properties in the same zone.
2) Failure to approve a variance will result in
undue hardship.
3) The alleged hardship has not been created
by the action of the applicant or the property
owner.
4) Approval of the variance is not in conflict with
public interest.
The CBC zone requires a 20 -foot setback
where there is a boulevard strip (which is
proposed). The 20 -feet is to be designated for
landscaping.
It appears that the applicant is requesting a
reduction in setback requirement from 20 feet
down to 8 feet. The variance would allow a front
yard setback reduction of 12 feet.
If a variance is granted, specific conditions
should be imposed regarding lanscaping and
fencing. Number of trees should be specified
along with sizes at planting, e.g. decidious trees
to be 2 -inch caliper at planting, evergreen at 7 -
feet in height at planting. Shrubs should be
provided in 5 -gallon containers. Groundcover
should be consistent with surrouinding area, i.e.
grass, trees, and shrubs. An irrigation plan
should be submitted to the City for review and
approval.
The district building to the north is at a zero -foot
setback within the front yard. The properties to
the south generally maintain a setback 20 feet.
