Conditional Use Permit Procedures
The City of Rexburg Zoning Ordinance designates certain land uses in each Zoning District which are allowed.
These are listed in the Zoning Ordinance for each zone. The Planning & Zoning Department should be consulted
if you have questions about whether your proposal will need a Conditional Use Permit.
If a C.U.P. is needed, you will need to get an application from the Planning & Zoning Department and fill it out for
a C.U.P. You will then need to return the application and request to be placed on the Planning & Zoning
Commission agenda at least 18 days prior to the meeting. Application and public hearing fees are required to be
paid up front. Prior to granting a conditional use, at least one Public Hearing shall be held to give persons an
opportunity to be heard. The Planning & Zoning Meetings are held on the 1" and 3"' Thursday of every month at
7:00 pm.
The Secretary of Planning & Zoning will put the notice for the hearing in the paper 15 days prior to each hearing,
mail a copy to all the property owners within 300 feet and post a notice on the property. After the Planning &
Zoning Commission holds their hearing they will make a recommendation to the City Council. The City Council
will take the Planning & Zoning Commission recommendation into consideration. If a hearing is required before
the City Council they will then take into consideration oral and written testimony as well as the recommendation
from the Planning & Zoning Commission. A decision will be made by the City Council within the time frame
allowed by Section 67-6511, Idaho Code.

The Commission or Council may address other points than those discussed above, but a narrative addressing at
least those applicable points will assist in processing your application. A PLOT PLAN MUST BE ATTACHED IN
ORDER TO PROCESS THIS APPLICATION. Included on the plot plan setbacks, parking, etc.

So forget your fears and lack of experience speaking in
Public and communicate your concerns and questions
on the matter at hand. Make notes—don't hesitate to
read from them if necessary.
Keep in mind the time limit for oral testimony (usually five
minutes) and the fact that others may also wish to speak.
It is wise to keep your emotions under control and treat
the presiding body with respect.
Upon. approaching the podium—be sure to state your
name and sheet address for the record. You do not have
to own property In the vicinity. This is I common oversight
on the pari of nervous citizens Although the presiding
officer usually gives a gentle reminder, the interruption
can disturb your train of thought and detract from your
comments.
Be sure to get your comments into the record before the
hearing is closed, Sometimes participants wait too long.
Once the hearing closes, discussion must be limited to
the presiding body and staff and no public participation
can occur.
Standards • Oral Testimony
Per Rexburg City Code, oral testimony should:
Directly address the subject at hand
Not be repetitious with other entries already in the
record
Not; be personally malicious
Comply with restrictions established by the
presiding officer (usuallyfive minutes)
Testimony not complying with these standards
maybe declared out of order and be required
to cease.
Per Rexburg City Code, written testimony at a
public heating is also admissible and should:
Be. submitted: one day prior to the public hearing
Include your address and signature

Hearings
Public Hearing?
In short, a public hearing is a legally -required
opportunity for the public to hear and respond to a
request by a petitioner. Requests may deal with
variances, conditional use permits, annexations,
and re -zonings.
Such hearings are conducted in accordance with
Idaho and Municipal Codes in a pre-set format.
Dependent upon the request at hand, hearings
may occur before the Planning & Zoning or the
City Council. The body acts in a quasi-judicial
capacity; judging requests against duly enacted laws
and standards.
Hearings are recorded and later transcribed into
official minutes which can be obtained on the city
of Rexburg's website at www.rexburg.org. Written
submissions are also included in the official records.
• Explanation of request by city staff
• Presentation by applicant
• Testimony from those supporting the
applicant
• Testimony by those uncominitted on
application
• Testimony by opponents the application
• Rebuttal by the applicant
• Closing of the public hearing
• Deliberations of the hearing body
• Develop findings and conclusions
Remember Your Objective: If you want to persuade
the hearing body to vote or decide in favor of your side
of the issue, it usually doesn't help your cause to anger,
alienate or antagonize them.
Know The Law: Officials are not likely to make
decisions in violation of city or state codes. No
amount of passion, exhortation, or pleading by citizens
will accomplish this. (However, laws can be changed. If
there is a bad laws organize to have it amended)
Show Your Strength:. Many neighborhood; groups
organize their testimony by having one or a few people
speak on behalf of the group. The leader will ask those
in the audience supporting the testimony to stand.
Speak to. the Point: Public officials have heard
hundreds of people give testimony. They are grateful
when the testimony is pertinent, well organized, and
directly regards the matter at hand.
State Your Recommendations: Don't leave the
Planning & Zoning and City Council wondering what it
was you wanted them to do.

If You Don't Wish to Speak Write: If written
testimony is specific; to the pointy and concise;tit will `
be given just 1.as much attention as oral testimony.
Written testimony should be delivered to the City Clerk
a day prior to the public hearing.
Be Reasonable: Put yourself in the shoes of the
hearing body. They must balance all views, interests
and proposals being made, and find the best course for
serving the overall public good. Be prepared
occasionally to compromise.

Don't Comment From the Audience: Due to the
need to record the proceedings and the necessity to
obtain the address of the individual commenting, such
testimony cannot be included in the record.
Avoid Mob Mentality: Cheering, scowling, muttering,
applauding, and other types of emotional behavior may
do more to harm your credibility than to help your case.
No Pre -hearing Contact: Contacting a member of the
hearing body concerning the matter for which the public
hearing is being held is inappropriate due to the quasi-
judicial nature of such proceedings.
Avoid Irrelevancies: Stick to the subject at hand.
Generally the presiding body cannot correct past
"wrong" and reciting "ancient history" about a site or
neighborhood usually detracts from your other, more
pertinent remarks.
Refrain from,Repetition:. Repeating -the same or
samhhr Comments again.and agva does not help your
argument The same applies to reiterating what another
citizen may have already said.
Avoid Directing Questions to Other Hearing
Participants:'. It is appropriate to direct questions to the
Chair or Mayor and he/she may choose to redirect them
to the appropriate individual(s).
Avoid Discussing General Concerns: Public hearings
on specific requests are not the time to air general
concerns with city government Contact the Mayor or
City Council outside the public hearing process to
address such issues.
