We constantly hear about Covid cases, and Covid deaths. There is even a new, expensive, electronic sign at the end of Main Street advertising these grim stats on a daily basis. But where is the data about the grim effects of misguided public policy? Why doesn’t the sign show the stats on business closings, job losses, poverty, higher cases of depression, drug abuse, domestic violence, teens thinking more about suicide, teens committing suicide, adults committing suicide, feelings of loneliness, fear, anxiety, health consequences of mask wearing, psychological consequences of masks, and the list goes on. Being solely focused on Covid cases and deaths is missing the point of all the negative, and very real effects of bad policy. The focus on cases and deaths ignore the real needs of people living their lives, pursuing happiness and being free to make their own decisions. The proposed ordinance is unconstitutional. Even if you believe the scientific claims about masks being effective, that doesn’t provide the Constitutional power to impose a mask mandate. The Constitution is a protection for the people from unjust government power and control. Nothing in the Constitution grants any level of government from infringing on our God-given rights. The freedom to walk in public with my face (made in the image of my creator) uncovered, the freedom to engage in commerce with local businesses, indeed the freedom to pursue happiness and gather and talk freely with my family is protected by the Constitution. The penalties on businesses is both wrong and unconstitutional. To require businesses to post the City’s DECREE and then be the ENFORCEMENT arm of the city is simply wrong. For many years I have argued against licensing of businesses because of the unnecessary regulations that come with licensing, but also because the THREAT OF REVOKING A LICENSE COULD BE ABUSED by the licensing board or local government. Businesses could be held hostage by local government. This ordinance is a prime example of such abuse. This ordinance will be a case-in-point going forward for removing license powers from local government. The Constitution holds that all government power derives from the consent of the governed. I stand before you, the people in this room, and in the hall, and in the lobby, and outside this building, and watching over the internet are the governed and they are expressing how they do NOT CONSENT to the unjust powers being claimed by the government via Ordinance 1243. Remember, it’s in times of crisis when we risk losing our liberty most. It’s upsetting how these wellmeaning leaders want to expand government and restrict the people. Our health and safety is our responsibility; not the Mayor’s and not the City Council’s. People should do what they think is best for them and their families and resist tyranny—even if the tyranny comes from a place of “caring.” I’m surprised how those who run for office often preach how they know and love the Constitution, but then when faced with an important issue like this one, either quickly abandon Constitutional principles or demonstrate how they never understood the Constitution to begin with. I will be deeply disappointed and upset to see good city council members vote for an unconstitutional ordinance after they themselves have taken an oath to uphold and defend the constitution.
