I am writing to express my anger and disgust at the current Mask Mandate with associated fines and penalties being considered at tonight’s meeting. I am having a hard time believing that such abuses of power would even be considered by our local community leaders. I also find it sad that you feel you have the power to trample individual rights using the excuse of public safety. I have read your proposal in detail and note several areas that should be brought to your attention. 1. The March 20, 2020 declaration of a disaster emergency was an overreaction and overstep of the powers given to the Mayor and City Council. At the time this was done, Madison County and Rexburg had some of the lowest numbers in the country. This was done as a reflex to what other states and politicians were doing and had no basis in fact. It was an absolute overstep of the powers and privileges granted to the Mayor and City Council. It would appear to anyone paying attention that a false emergency was created to allow you to then assume powers and authority that you would otherwise not have as the Mayor and Council Members. One might think that you see yourselves as the enlightened ruling class that must make choices for us "average people" who just aren't smart enough to make our own decisions. Only you enlightened ones have the ability to think for everyone. But don't feel alone, many dictators have felt just like you throughout history. So your actions, although disturbing, are not that original. 2. I want to point out your hypocrisy in the ordinance under section 3-a: You have the audacity to tell me I have the "constitutional right" to turn away patrons without service for not wearing a mask, but leave out the obvious inverse of this statement: I should also have the "constitutional right" to provide service to patrons who don't want to wear a mask if I so choose. Can you not see your own hypocrisy? 3. As a physician, I have done extensive research into the current mandates and unconstitutional orders that have been implemented across our country by leftist politicians who believe the rights of the individual are inconsequential, and that we should base our laws on the "good of all" and ignore individual rights. This is the exact opposite of the intent of the founding fathers. In our country we have already seen legal battles over similar ideas - i.e. vaccinations. We know that vaccination of everyone is a benefit for society and helps protect "the good of all", yet our courts and judges have already ruled that the right of the individual supersedes the rights of the many, and we have been given the right to choose whether to vaccinate ourselves and our children. It was determined that this is not something that those in power can legislate. How in any way is the mask mandate different? The legal precedence has been set, and I suspect, that by the time this pandemic is over, the number of lawsuits against city and state governments will be a whole new disaster for our country. You should not even want to take away the right of individuals. If I want to wear a mask and social distance myself from others, then I have that right, but I should not be forced by Mayor Merrill and the City Council to wear a mask for my own safety. That is an excuse you use to infringe on my rights. If you believe masks protect you, then your argument is nonsensical! If you are wearing a mask and the mask protects you, then it doe not matter if I wear one. I am putting no one, but myself at risk if you are correct in your argument that masks work! The entire basis for your mandate thus becomes ridiculous and a logical fallacy. If you believe a mask protects you, and you are wearing one, then why do you care if wear one or nott? There is no explanation you can give to justify your proposed action. Again: IF A MASK PROTECTS YOU AND YOU ARE WEARING ONE, THEN WHY DO YOU CARE IF I DO? I do not want you to be my parent or my controller. I do not want you to assume risk for me. IF YOU FEEL STRONGLY ABOUT MASKS, THEN WEAR ONE AND LEAVE ME ALONE! Others rights end where my rights start. Remember that crazy concept? It is one of the founding principles of our government. 4. In addition, if you believe that a cloth mask or standard paper mask, (i.e - surgical mask) protects you from anything then you have listened to the political double speak being put forth by media, leftist politicians, and misguided medical professionals. There were over 14 studies done after the previous corona virus outbreaks in the US that looked at mask use and whether or not it prevents the spread of corona type viruses - every single study came to the same conclusion, and that is that they do not work! In fact, the most recent study out of Denmark came to the exact same conclusion – Paper and cloth masks do not protect you. This study was just published in the Journal of Internal Medicine if you don’t want to believe me, then look it up. That is the science behind this. Anyone who claims a thin piece of cloth protects you has an agenda, and that agenda is control, not safety. The only mask that can protect you from potential spread of a coronavirus is an N95 mask that is properly fitted. Any statement contrary to this is a direct misrepresentation of the medical research that has come forward over the last decade. That is why Dr. Faucci stated initially that masks were unnecessary and did not protect you. Why did he later change his mind? Was it new studies? NO - it was social and political pressure. And that is the sad state of where we have arrived. Facebook and Twitter influence our leaders more than science. Only a mandate of N95 masks would be effective, and again, if you want to be protected - wear one, but don't call forcing me to wear one if I chose not to a public safety issue - that is a personal safety issue and it is my right to determine if I want to take these measures or not. It should never be left to government to dictate what my private business does or what I do as a private citizen. People can choose to not support a business that does not require masks - people can choose to wear a mask whether effective or not. A business can choose to require its patrons to wear masks or seek service elsewhere. YOU, AS LOCAL POLITICIANS, should not have the choice to control what my business does or what I do - period! 5. You cannot stop the spread of Covid 19 through our population. It is arrogant to think we have the ability to control this. It will go through our population whether we want it to or not. The stated goal from the federal government was to "slow the spread," that was done, and we have attempted to destroy our economy since with shutdowns and Draconian measures instituted by leftist politicians who feel they should be able to ignore our rights and treat us as if we are too stupid to make our own decisions and take our own risks. Believe or not, I do not need a local small-town city government to attempt to control me! I have already had COVID-19, I have a very low risk of getting it again. I get exposed frequently as I see sick patients. I don't need or want your protection. I value my rights more than I value a false sense of safety provided by people who are not experts in any way on the topic at hand. 6. I do not care if you want to release statements with recommendations about masks, social distancing, or whatever! BUT- a suggestion for my safety is where your control should end. At that point we can accept our own risks for life and health. If my choice leads to my death, you should not have any control over that. AGAIN, everyone can choose to wear a mask if they want to. Whether the people around them do is not up to them. We have personal rights. Please stop trying to take them from us. you should be ashamed to even have written this proposal. You have no right to fine me or my business for not following an ordinance that you have no legal right to propose in the first place. Threatening fines and business closures?? For that fact alone, you should resign immediately! Any council member who supports this should also resign. This is abuse of power and position. Please check yourselves. Remember why you ran for office. Provide any suggestions you would like based upon whatever information you choose to believe, but do not disregard the rights and liberties of the people you claim to represent. This action is an afront to the liberty of the individual and is a virtue signal, not something that will actually make a difference. Stop the abuse of power and throw this power grabbing ordinance in the trash where it belongs. 7. My last statement is to offer my sympathies for the difficult postions you are in. I realize you are porbably getting a lot of pressure from outside interests and you probably feel that putting in place this ordinace will take off some of the pressure. I am sorry for the difficulties you are faced with, but I will not give you a pass to abuse personal liberty to lessen the pressures you face. Stand up for what is right and keep the oaths you took as our representatives to uphold the laws and liberty of our city, county, state and nation.
