Dear Mayor Sutherland,
At the City Council meeting, June 19, Councilman Pugmire suggested we obtain a statement from
our Insurance Companies regarding any special requirements for paint booths. I have enclosed a
statement from my agent, Gary Archibald. My insurance carrier has inspected my shop and has
not required me to have a sprinkler system.
I would like to take a moment to present the facts as I see them:
1. It hasn't been proven that my shop presents any special fire hazard.
2. Our products are less flammable now than ever before. That makes us safer than ever
before.
3. When structures are built they must meet current codes. As they get older, new codes
supercede old codes. The Grandfather Clause was created so a person wouldn't have to
tear his building down and rebuild each time a new code came out. If there is no
extraordinary safety hazard the building is "Grandfathered". Our safety record speaks
for itself.
4. Existing booths in Pocatello and Idaho Falls have been Grandfathered. This would set a
precedent for Rexburg to follow. At the Council meeting it was suggested we were
asking for special treatment. This is not the case. We are only asking for the same
treatment as other shops in our area. We don't feel we should be held to a higher standard
simply because we are located inside Rexburg. That would be akin to saying, "only
Rexburg residents have to obey the speed limit, everybody else go as fast as you want."
5. Almost any building in Rexburg that is more than ten years old will not meet all current
fire codes. Is the city ready to check each building for violations. If it is not, that could be
considered discrimination.
I would like to thank you for listening to my opinions. I feel I have made a good case in
favor of Grandfathering my business. Unless it can be shown that we present a safety problem, I
don't feel we should be singled out.
For your convenience, I am enclosing copies of this letter for each City Council member.

Re: Paint booth.
Dear Vardis:
At your request, I forward this letter regarding the paint booth in your building.
Because the paint booth is walled off from the rest of the building by cinderblock,
the building is not surcharged. Because of the paint booth, the insurance company
has inspected and because of the way you store the paints and the fact that the
paint booth is separate and walled off from the balance of the building, the policy
is O.K.
I would be happy to provide additional information if it is needed.

Re: Sprinkling system for paint booth
Dear Leon:
At your request, I reviewed with the Idaho Surveying and Rating
Bureau in Boise, the estimated premium savings if a sprinkling system
were installed in your building. The Idaho Surveying and Rating
Bureau establishes the base rate for each commercial building in Idaho
(either class rated or specifically rated).
The rate credit for a sprinkling system varies by coverage, pressure, etc.
but is normally 25% to 35%. That means for your building your
property premium would reduce by $185.00 to $250.00 annually-
Q.t this time, we have no problem providing an insurance policy for your
building without a sprinkling system.
