ZONE CHANGE
On November 12, 2002, David Pulsipher presented to the Rexburg City Clerk a Request
and Application for a Zone Change that includes properties south of 3`d South to
properties facing north on 5th South. The west side of 3`d East going to the east
properties on the west side of 4th East. Properties adjoining 3`d East, Yale Avenue and the
west side of 4th East going south to 4th South in the City of Rexburg, said property to be
changed from Low Density Residential 1 (LDR1) to Low Density Residential (LDR).
2. On December 19, 2002, David Pulsipher appeared before the Planning & Zoning
Commission for the City of Rexburg requesting a zone change of said property that
includes south of 3`d South to properties facing north on 5th South. The west side of 3`d
East going to the east properties on the west side of 4th East. Properties adjoining 3`d
East, Yale Avenue and the west side of 4th East going south to 4th South from LDR1 to
LDR. The Planning and Zoning Commission recommended adding eight parcels on the
east side of Harvard Avenue. It was recommended that this request should go to public
hearing.
On December 27, 2002, the City Clerk sent the Notice of Public Hearing to be published
in the local newspaper on December 30, 2002, and January 13, 2003. A notice was
posted on the property and sent to all property owners within 300 feet of the above
mentioned property.
4. On January 16, 2003, David Pulsipher appeared before the Planning & Zoning
Commission for the City of Rexburg requesting a zone change from LDRI to LDR on
property that includes south of 3`d South to properties facing north on 5th South. The
west properties are on the east side of Harvard Avenue, going to the east properties on the
west side of 4" East. Properties adjoining 3`d East, Yale Avenue and the west side of 4th
East going south to 4th South. There was one person who gave testimony against this
proposal due to wanting to have an apartment in the home. There were numerous
residents that testified in favor of this proposal. It was recommend by Planning & Zoning
that this request be approved for public hearing before the City Council.
5. On January 21, 2003, the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper on January 22, 2003, and February 3, 2003. A notice was posted on
the property and sent to all property owners within 300 feet of the above mentioned
property.
6. On February 5, 2003, David Pulsipher appeared before the City Council of the City of
Rexburg requesting a zone change on property that includes south of 3`d South to
properties facing north on 5th South. The west properties are on the east side of Harvard
Avenue, going to the east properties on the west side of 4th East. Properties adjoining 3`d
East, Yale Avenue and the west side of 4`'' East going south to 4t' South from LDR to
LDRI . David Peck gave testimony in support of the zone change as a representative of
the 3rd East Neighborhood Association. It was moved and unanimously approved that the
Council take the recommendation of Planning & Zoning and approve the requested zone
change.
