Absent: David Pulsipher, Sally Smith. Minutes: Planning & Zoning Meeting October 15, 2020 (action) MOTION: Motion to approve the minutes for October 15, 2020, Action: Approve, Moved by Kristi Anderson, Seconded by Todd Marx. VOTE: Motion carried by unanimous roll call vote (summary: Yes = 9). Yes: Aaron Richards, Chairman Rory Kunz, Greg Blacker, Jim Lawrence, John Bowen, Kristi Anderson, Todd Marx, Vince Haley, Randall Kempton. There are a few minutes before the public hearing can start. A couple of items of note: the first item on the “Heads Up” for the November 19th, 2020, public hearings list for a rezone for 376 W 4th S will be moved to December 3rd due to a newspaper printing error of the notice. Public Hearings: 1. 6:35 p.m. – (20-00770) – 1332 & 1350 Thompson St - Rezone from Community Business Center (CBC) to Light Industrial (LI) in the Impact Area. (action) – Ryan Summers Applicant Presentation – Ryan Summers – 949 Preston Dr. – He currently works for Valley Agronomics. They are in the process of purchasing the property from Thompson Paving. His boss, Cortney Beck, asked Ryan to attend the meeting tonight. Valley Ag is working on the rezoing provess from commercial to light industrial, so the light industrial zoning will match the zoning of their current property across the street to the south. Commissioner Questions: None Staff Report: Planning & Zoning – Alan Parkinson – Alan brought up the map to locate the property. The property is located on Thompson Street. There are eight parcels included in this zone change changed from Community Business Center to Light Industrial. The request matches the uses of the area. The Comprehensive Plan shows Industrial here. Sewer and water can be made available if needed. Staff recommends the City Planning & Zoning Commissioners recommend this to the County Commissioners, as they will be the final decision makers. Commissioner Questions for Staff: Vince Haley asked if there would need to be a traffic study. Alan answered, not at this point. Keith Davidson, with Public Works, reviewed the request. Increased traffic is not anticipated at this location, other than what was already going to happen with the expansion of the fertilizer plant to the south. Conflict of Interest? - Chairman Rory Kunz asked the Commissioners if they have a conflict of interest or if they have been approached by any parties relative to this particular subject. If you believe your prior contact with respect to this subject has created a bias, you should recuse yourself, otherwise at this time please indicate the nature of your conversation or contact. As a matter of disclosure, Rory Kunz lives in the neighborhood. No other conflicts of interest. Chairman Rory Kunz reviewed the public hearing procedures. Favor: None Neutral: None Opposed: None Written Correspondence: None Rebuttal: None Chairman Rory Kunz asked if anyone else would like to speak. He closed the public input portion of the hearing at 6:40p.m. Commissioners Discussion: Greg Blacker has not problem with this request. He feels it is a good use of the property. This is just a little housekeeping. Kristi Anderson agrees with Greg. She says it fits with the Comprehensive Plan. It is in a good location next to Highway 20. The current use and future use are very similar. She has no problem with making this change. Chairman Rory Kunz wondered why the property was ever changed to commercial in the first place. He does not know why that area would ever be utilized as such. MOTION: Move to recommend the County Commissioners approve the rezone of 1332 and 1350 Thompson Street from Community Business Center (CBC) to Light Industrial (LI), because it makes sense with Light Industrial to the south and it will be a good use of that property, Action: Approve, Moved by Vince Haley, Seconded by Greg Blacker. There will be three items on the agenda. Alan asked what the Commissioners want to do with the second meeting in December. The meeting will be on December 17th. The deadline for application submittal is Monday, November 9th, and no applications have 3 been received. The meeting will depend on applications that come in. The Commissioners who could attend would make a quorum. Heads Up: November 19, 2020 Hearings: 1. (20-00661) – Remove Technology Office Zone (TOZ) from the Development Code 3. (20-00816) – 215, 217, 219 & 225 N 3rd W – Rezone from Low-Density Residential 2 to Medium- Density Residential 2 4.
