NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the City Council of
the City of Rexburg, Idaho, Wednesday, February 19, 2003, at 7:35 p.m., in the City Council
Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding a zone change
from Light Industrial (LI) to Highway Business District (HBD).
The said properties are located at 485 North 2"d East in Rexburg, Madison County, Idaho, and
more particularly described as follows:
Tract 1: Commencing at the Northeast corner of the Southeast Quarter of the Northeast Quarter
of Section 19, Township 6 North, Range 40 East, Boise Meridian, Madison County, Idaho, and
running thence North 89°5' West 1102.1 feet to the East Union Pacific Railroad right of way;
thence South 30°23' West 475 feet along said right of way; thence South 87° 24' East 682.5 feet;
thence South 88° 05' East 501.24 feet; thence North 422.2 feet along the section line to the point
of beginning.
Less: Commencing at a point which is 864.7 feet North and North 88° 05' West a distance of 140
feet from the Southeast corner of the Northeast Quarter of Section 19, Township 6 North, Range
40 East, Boise Meridian, Madison County, Idaho, which point of beginning is n the North line of
the Teton River Flood Control Project right of way and running thence Westerly along said right
of way line on a course North 88° 05' West approximately 65 feet to a point which is on a line
running North from a point which is 525 feet West of the Southeast corner of the Northeast
Quarter thence North 205 feet; thence South 70°35' East 365.6 feet; thence South 35°22' East
69.1 feet to the point of beginning.
Tract 2: Commencing at a point which is 864.7 feet North and North 88°05' West a distance of
140 feet from the Southeast corner of the Northeast Quarter of Section 19, Township 6 North,
Range 40 East, Boise Meridian, Madison County, Idaho, which point of beginning is on the
North line of the Teton River Flood Control project right of way and running thence Westerly
along said right of way on a course North 88° 05' West approximately 320.6 feet; thence South
40 feet; thence North 88° 05' West approximately 65 feet to a point which is on a line running
North from a point which is 525 feet West of the Southeast corner of the Northeast Quarter;
thence North 205 feet; thence South 70° 35' East 365.6 feet; thence South 35° 22' East 69.1 feet
to the point of beginning.
At such hearing the City Council will hear all persons and all objections and recommendations
relative to such proposed permit. The City Clerk will also accept written comments at City Hall
prior to 4:00 p.m. on February 18, 2003.
This notice is given pursuant to the provisions of Section 67-6509 and 67-6511 Idaho Code, and
all amendments thereof.

I, Terry T. Weatherston, being first duly sworn, depose and
say, that I am the printer of THE STANDARD JOURNAL,
a 3 times a week newspaper printed and published 3 times a
week in Rexburg, Madison County, Idaho; and I do
solemnly swear that the Public Hearing - 485 North 2nd
East, Rexburg, a copy of which notice appears attached
hereto, was published in the regular and entire issue of said
newspaper, and not in any supplement issue, once every
other week thereof for Two weeks, the first publication
having been made on February 3, 2003 and the last
publication having been made on February 17, 2003.
Further, that said newspaper is one of general circulation in
said county; that it is a legal newspaper, conforming to
legal specifications under the Idaho Statutes; that it has at
least two hundred bona fide subscribers living within the
county of publication; and that it has been continuously and
