NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the Planning &
Zoning Commission of the City of Rexburg, Idaho, Thursday, June 19th, 2003, at 7:05 p.m., in
the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding
annexation and a zone change from Madison County zoning to Rexburg zoning.
These properties are primarily located in five (5) areas within the Rexburg City Area of Impact,
Madison County, Idaho, and are described as follows on the Annexation Map dated
May 19,2003:
Annexation Areal: — WA b i1
Area includes a single parcel at 801 West Main Street. Water and Sewer Services are already
available to the proposed parcel. The parcel is currently an island in the middle of the City. The
parcel fronts City streets and has access to municipal police and fire protection. This parcel is a
petitioned annexation.
Parcel numbered on the Annexation map as follows: Area One (1)
Proposed Rexburg City zoning for this parcel is: Low Density Residential (LDRI)
The Legal description is follows:
Commencing at a point that is 95 feet east of the NW corner of the NEI/4 of Section 25,
Township 6 North, Range 39 East, B.M., Madison County Idaho, and running thence
South 265 feet; thence East 235 feet; thence North 265 feet; thence West 235 feet to the
point of beginning.
Annexation Area 2:
Area includes two adjoining Parcels at the corner of Main Street and 12th West Street. Water
and sewer services are already extended to the west side of US 20 and Sewer service will be
bored under State Highway 33 to serve this annexation area to the north in the summer of 2003.
These two parcels are petitioned annexations.
Parcels are included on the Annexation map as follows: Area Two (2)
Proposed Rexburg City zoning for these parcels is: Highway Business District (HBD)
The Legal descriptions are as follows:

Commencing at the Southwest Corner of Section 24, Township 6 North, Range 39 East,
Boise Meridian, Madison County, Idaho, and running thence North 0009'30" West a
distance of 846.70 feet along the West section line; thence North 90°00'00" East a
distance of 48.00 feet to the true point beginning; thence North 0°09'30" West, a
distance of 768.80 feet; thence North 90°00'00" East, a distance of 962.96 feet; thence

South 0°00'00" East, a distance of 768.79 feet; thence North 90°00'00" West, a distance
of 10.0 feet; thence South 0°00'00" East, a distance of 806.70 feet; thence North
90°00'00" West, a distance of 30.00 feet; thence North 0°00'00" East, a distance of
806.70 feet; thence South 90°00'00" West, a distance of 920.84 feet to the point of
beginning.
Tract 2a
Beginning at a point that is East along the Section line 375.00 feet and North 371.70 feet
from the Southwest Corner of Section 24, Township 6 North, Range 39 East of the Boise
Meridian; running thence North 475.00 feet; thence West 377.34 feet to the West line of
said Section 24; thence S. 00009'30" E. along said West line 475.00 feet; thence East
376.03 feet to the point of beginning.
Tract 2b
Beginning at the Southwest Corner of Section 24, Township 6 North, Range 39 East of
the Boise Meridian; running thence East along the Section line 375.00 feet; thence North
371.70 feet; thence West 376.03 feet to the West line of said Section 24; thence S.
00009'30"E. along said West line 371.70 feet to the point of beginning.

Beginning at a point that is east along the Section line 375.00 feet from the Southwest
Corner of Section 24, Township 6 North, Range 39 East of the Boise Meridian; running
thence east along said Section line 385.00 feet; thence North 371.70 feet; thence West
385.00 feet; thence South 371.70 feet to the point of beginning.

Beginning at a point that is East along the Section line 760.00 feet and North 371.70 feet
from the Southwest Corner of Section 24, Township 6 North, Range 39 East of the Boise
Meridian; running thence North 113.50 feet; thence West 385.00 feet; thence South
113 50 feet; thence East 385.00 feet to the pvliit of beglllliillg.
Annexation Area 3:
Annexation area includes all parcels not already annexed lying north of 7t' North and following
the North Yellowstone Hwy on the west side and the section line on the east side thence north to
the drive in theatre. Water and sewer services will need to be extended to annexation parcels on
the north end of area 3. Annexation areas currently have access to City water and sewer from
mainlines existing on 7th North. Transportation right of ways will need to be acquired as part of
the annexation process. Future road development will be as per the City transportation plan as
coordinated with Madison County. Twelve (12) of the Twenty (20) parcels in this area have
petitioned for annexation.

Proposed Rexburg City zoning for these parcels is Highway Business District (HBD)
next to the highway and Medium Density Residential (MDR) East of the HBD with
Low Density Residential (LDRI) on the East part of Area 3.

Meridian, Madison County, Idaho excepting those areas already in the City of Rexburg.

Beginning at a point 51 feet North of the Center Quarter Corner of Section 17, Township
6 North, Range 40 East, Boise Meridian, Madison County, Idaho and running thence
North 795 feet; thence West 401 feet; thence South 675 feet; thence West 363 feet to a
point that is 537.0 feet East of U.S. Highway 191 right of way; thence South 120 Feet;
thence East 764 feet to the point of beginning
Tract 3
Commencing at a point on the East right-of-way line of Highway U.S. 191 East of Station
535+69.20, which point is also 2677.8 feet North and 1316.0 feet East of the Southwest
corner of Section 17, Township 6 North, Range 40 East, Boise Meridian, Madison
County, Idaho; and going thence North 30°40' East along the right-of-way a distance of

Annexation Area 4:
Area includes all parcels east of Millhollow Road to the Section line between 7th South and north
to the Woodmansee ditch bordering the north side of the Summer's property. Water and sewer
services will need to be extended to most of this Annexation area. Part of the Annexation area
on the west side of Millhollow Road currently has access to City water and sewer.
Transportation right of ways will need to be acquired as part of the annexation process. Future
road development will be as per the City transportation plan as coordinated with Madison
County. Eight (8) of the nine (9) parcels have petitioned for annexation.

Parcel includes what is otherwise referred to as the Cook Farm East of 2nd East and South of 11th
South. Water and sewer services will need to be extended to all of annexation area 5. City
Street Right of Ways need to be dedicated.

Proposed Rexburg City zoning for these parcels is Low Density Residential (LDR) with
a small corner of Medium Density Residential (MDR) bordering 2nd East and 7d'
South.
The Legal description as follows:
Tract 1
All of the East half of the East half of Section 31, Township 6 North, Range 40 East,
Boise Meridian, Madison County, Idaho excepting those areas already in the City of
Rexburg.
Tract 2
All of the West half of the West half of Section 32, Township 6 North, Range 40 East,
Boise Meridian, Madison County, Idaho excepting those areas already in the City of
Rexburg.
Tract 3
All of the Southeast Quarter of the Northwest Quarter of Section 32, Township 6 North,

At such hearing the Planning & Zoning Commission will hear all persons and all objections and
recommendations relative to such proposed approval. The City Clerk will also accept written
comments at City Hall prior to 4:00 p.m. on June 18, 2003.
This notice is given pursuant to the provisions of Section 67-6509 and 67-6511 Idaho Code, and
all amendments thereof.
