Barney Trucking (Dell Ray Barney) Licensing Violation: Business License Expired over a year, Violation of City Ordinance 709. Investigation Authority: On this date, the Administrator of Planning and Zoning directed me to conduct an investigation, initiated because of a citizen complaint to the City Offices. The site was reviewed on the graphic files of the city's GIS program, as a means of determining field identification and conditions existent at the time of creation of the graphics system. Adjacent residences have stated that this site is onerous and offensive to them personally, and it disregards, in their opinion, the neighborhood values of the community at large. It's appearance of neglect is held to be intrusive on their visual privacy, demeans the neighborhood, and serves to threaten adjacent property values. The P&Z Administrator stridently asserted his desire to develop evidence, which would enable rapid and effective adjudication, with immediate enforcement leading to abatement and/or mitigation of the existing conditions, via misdemeanor prosecution. This report will attempt to provide all evidence available at this time. The reader should treat this investigative report sole as evidence of all existing conditions documented, or observed by the author. The summary section will contain perspectives from an enforcer's point of view. HISTORY: An immediately available overview of this site, historically, in recent years is provided with a review of correspondence from the City Prosecutor's Office, and secured from one of the adjacent neighbors, Ms. Naomi Kingston, residing at 419 West 1S{ North. Exhibit 1: Letter from The City of Rexburg to the parcel owners, dated January 31, 2001. Exhibit 2: Letter from The City of Rexburg, dated April 25, 2001. (NOTE: it is suggested that there exists additional correspondence from the city in this matter, as information received from Ms. Kingston indicated action for mitigation was directed by the city with the purported agreement of the site owners to comply by spring of 2004. There is evidence that the conditions have improved- very marginally- with action taken by the owners this last spring.) On -Site Investigation: This Investigator arrived on-site at approximately 1400 hrs, September 02, 2002. Site Access: For the record: The site was unfenced and unidentified with regard to either ownership, or activity. Neither the property, nor the single structure, was posted against entry, or trespass. General Site Overview: The site is in a generally residential area, with adjacent homes on either side. The site is an irregular parcel, extending south to a residential property line. The width of the site increases to the East, and extend to encompass the south boundary of the residential lot and home located at 405 West 1't North (Owner, Ms. Martha Covington). The target site is bounded physically, on the East, by a canal, which likely carries irrigation water. There is no buffer type fences, with the exception of a six-foot "Good Neighbor " fence on the south line of the Covington property. Surfacing: There is no paving of the target site, only gravel surfacing. The site is marked with unattended or, uncontrolled weeds, mostly on the south portion and along the west property line. These reach five feet in height in places. While providing no buffering, visually, they do provide concealment for vandals, etc. As might be expected, the gravel surfacing shows indications, particularly around the site perimeter, of petrol -contamination. The site is not bordered with sidewalk, only the curb and gutter on W1 stN. The access is gravel, as is the driveway to the house on the East side. Utility Services: No electrical service lines or service meters were observed on the site, or on the single structure. Water service records of The City of Rexburg indicate that: There has been no utility consumption in over a year. Structure: The single structure is of wood frame, single story construction, in a deteriorating condition. It appears to have had no improvement or maintenance which would serve to mitigate the neighborhood environment, or appearance. The building is served with a vehicle entrance on the North side, and a `man - door' on the East side. There appears to be no security system in place, and the individual -entry door has four glass panes, one of which is broken out. No effort to enter the building was made in this investigation. Viewing the interior via the broken door and a window on the South side was performed, however. The structure has a concrete floor to some extent at least. While one of the vehicles is, in fact, a commercial Heavy Equipment Tow Truck, and usage may be more related to the owner's performance as a towing and recovery firm, the other two may well meet the bar for Barney Trucking, and this author is persuaded that the terms employed by the last Business License of "Barney Trucking" is applicable to the two(2) trucks in this location and would expect that the location and usage of the Tow Truck is reasonably temporary and transient. Alleged Violations: Single violation of Ordinance 709 (Business licensing and registration) Photo Exhibit 6 Location F: In the South West corner of the Target Site, there is located a fifth wheel, construction site office trailer marked uAce Mechanical', with California Plates, and a Box -truck marked with a campaign support truck advertising a candidate for Fremont County Sheriff. The truck has a temporary plate, which expired 05/21/04. Alleged Violations: Appears only two (2) violations, given a perception that "Barney Trucking" is an allowed usage under City Licensing (Expired), that being a violation of Ordinances 725 (Zoning) & 709 (Business Licensing and Registration). Additional Observations: There exists, on the property, several other items. At two (2) locations are piles of waste dirt, which contribute to adverse perceptions within the neighborhood. A fuel tank from a heavy OTR vehicle exists near the East boundary. The tank is empty of liquid, but may have been emptied on the lot. Additionally, a large amount of fencing exists on the site, but has not been installed. This includes some salvaged fence posts which appear to have been required to be installed prior to this time. Lastly, several accumulations, (or piles) of waste dirt or gravel material have been accumulated on the site. These are in violation of City Ordinances, and detrimental to the maintenance of community standards. Nuisance Issues: City Ordinances 706, 379, (weeds) and 405 (Gravel) all appear to have bearing upon this case. The existence of the singular structure on the property would seem to suggest existence as an "Attractive Nuisance" for juvenile and adult perpetrators alike. The element of hazard to the public can be easily demonstrated by the evidence at hand. The site is neither buffered, nor secured. The structure is neither secure, or even posted. The inoperable vehicles are neither secured, nor protected. These issues may be presumed to attract adult and juvenile perpetrators to the neighborhood, to the danger of constituent residents. At that time, it was agreed, and I thought understood, that there could be no use of the property on the South side of I" North for rental of U -haul trucks, and that as long as this was adhered to, no action would be taken on the part of the City to have the U -hauls removed. It was further your representation to the City that the primary purpose for the U -hauls being at that location was for repairs. Since that meeting, it has come to our attention that in fact you are not repairing, but renting the U -hauls from that location. Since you have failed to abide by the understanding that was reached at our first meeting, this letter is to inform you, that you have 30 days from the date of this letter to remove the U - hauls from the property, or face prosecutions for violating the City's Planning and Zoning Ordinance. I have enclosed pictures of at least two instances of violation, and hope that you will see fit to resolve this matter without forcing the charges to be filed. During this same time period, several of your neighbors have expressed concern relative to the expansion of your commercial ventures in the vicinity of their residential uses. Accordingly, I have been asked to convey to you the understanding of the City relative to your rights at this location. On the North side of I" North you were granted a right to conduct the business associated with automotive towing, and minor repairs. You were further given a conditional use relative to barbed wire on your storage area fence, with the understanding that you would be placing sight restricting slats within two years of erecting the fence. To date the sight restrictions have not occurred, and given recent commitments you apparently made to Fremont County, we would like to remind you that the City of Rexburg considers your obligation to place the slats around your Rexburg place of business, to be imperative to maintaining the secure storage area in its present location. With respect to the property on the South side of I' North, there is some question as tojust what was grandfathered. To clarify, the property purchased from Jack Covington is not commercial or industrial property. It merely has a grandfathered use consistent with the use that Mr. Covington was engaged in at the time of the Ordinance passage. In conversations with Mr. Covington, that use consisted entirely of light manufacturing, and occasional machinery repair. At no time was there commercial rental, or automotive sales transacted from that location. Nor was there any type of storage facility. The placement of storage containers, moving vans, or D. J. Any agreement the City has relative to the properties in question, is limited by the applicable grandfathered use, and does not extend the grandfathering beyond traditional interpretation. In summary, the City expects you to follow through on the assurances to place sight slats in the chain link fence, and to discontinue the holding of storage containers and moving vans upon the property in question immediately, or further legal action will be called for.
