ORDINANCE NO. 1234
Annexing Approximately 15 North 12'x' West
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE
CITY OF REYBURG, IDAHO; DESCRIBING SAID LANDS
AND DECLARING SAME A PART OF THE CITY OF
REXBURG, IDAHO; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of
Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been
requested to annex the same to the City of Rexburg, Idaho, and
WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that
the hereinafter described property is subject to annexation to the City of Rexburg under
and pursuant to the provisions of Section 50-222 - Category A, Idaho Code, and that said
lands should be annexed to and become a part of the City of Rexburg, Idaho, and
WHEREAS, the City Council referred the zoning of the affected territory for report and
recommendations to the Planning and Zoning Commission, and the Planning and Zoning
Commission made its report and recommendations for zoning classification of the
hereinafter described properties proposed to be annexed, and
WHEREAS, the Council has determined that the proper classification under the Zoning
Ordinance of the City of Rexburg, Idaho, for the property to be annexed is as hereinafter
set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF REXBURG, AS FOLLOWS:
The property located at 15 North 12`' West in the Community Business Center (CBC)
zone; in the Impact Area for the City of Rexburg. This property (#20-00545) is hereby
annexed to the City of Rexburg and is hereby declared to be a part of the City of Rexburg,
Idaho. The zoning for the property will remain as Community Business Center (CBC)
zone. The property is described as follows on the updated Annexation Map:
Legal Description:
Tract 1:
Commencing at a point South 89°54' West 160 feet from the Highway right of way and
fence line, and from Southeast corner of Section 23, Township 6 North, Range 39 East,
Boise Meridian, Madison County, Idaho, and running thence North 160 feet; thence East
to the property line 160 feet thence South along the property line 160 feet and thence
South 89°54' West 160 feet to the place of beginning. EXCEPT: State Highway 33 and
County Road.
SUBJECT TO all existing easements, claims of easements, patent reservations, rights of
way, protective covenants, zoning ordinances, and applicable building codes, laws and
regulations, encroachments, overlaps, boundary line disputes and other matters which
would be disclosed by an accurate survey or inspection of the foregoing described real
property.
Tract 2:
Beginning at a point that is 160.00 feet S 89°54'00" W and 61.50 feet N 00°27'57" E of the
Southeast comer of Section 23, Township 6 North, Range 39 East, Boise Meridian,
Madison County, Idaho, and running thence N 00°27'57" E 98.5 feet; thence South
89°54'00" West 15.00 feet, thence S 00°27'57" W 98.5 feet; thence N 89°54'00" E 15.00
feet to the point of beginning.

SUBJECT TO all existing easements, claims of easements, patent reservations, rights of

regulations, encroachments, overlaps, boundary line disputes and other matters which
would be disclosed by an accurate survey or inspection of the foregoing described real
property.
SECTION I: That the above described property hereby annexed to the City of Rexburg
be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg
as above set forth; that the Zoning shall be amended to show this annexation and
classification of the above described property so annexed and that said amendment shall
be certified to and declared to be the official Zoning Map of the City of Rexburg by a
certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
SECTION II: This ordinance shall be in full force and effect from and after its passage,
approval and due publication.
PASSED BY THE CITY COUNCIL AND APPROVED BY THE MAYOR this 7" day
of October 2020.
