HomeMy WebLinkAboutFINDING FACTS - 03-00022 - Verizon Wireless - Monopole TowerFINDINGS OF FACT FOR CONDITIONAL, USE PERMIT On January 16, 2003, Richard Smith presented to the Rexburg City Clerk a Request and Application for a Conditional Use Permit on property located on 1202 E. Poleline Road in the City of Rexburg, said property to be for a Cellular Tower. 2. On February 6, 2003, Richard Smith appeared before the Planning & Zoning Commission for the City of Rexburg requesting a Conditional Use Permit of said properly for a Cellular Tower. It was recommended that this request should go to public hearing. 3. On February 11, 2003, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper on February 12, 2003, and March 3, 2003. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 4. On March 6, 2003, Richard Smith appeared before the Planning & Zoning Commission for the City of Rexburg requesting a Conditional Use Permit for a Cellular Tower on property located 1202 E. Poleline Road. A motion was made and passed to approve the request to relocate the cell tower to the new location by the City water tower with the following conditions: 1) The tower must be lighted at the top for air traffic. 2) The tower must be at the same or lower elevation as the water tower. 3) The building and tower must be fenced. �- Stephen4Zollinger, City AtQney
