AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
This property is part of the Klingler Addition to Rexburg. The lot was originally thought to be a
commercial development area, but with recently proposed changes to the Pedestrian Emphasis District,
this area is believed to be more residential. The City has sponsored a Comprehensive Plan Map change
to this parcel, along with several others within the block and across the street to the south in case 20-
00660. The Comprehensive Plan Map request is set to be final approved or disapproved November 4,
2020, by City Council.

The Rexburg Development Code allows the Commission to make recommendations to the City
Council regarding whether or not the property should or should not be rezoned based on the criteria
found in section §1.04.020.
II. SITE DESCRIPTION
The property is located on the corner of S 4th W and W 4th S at 376 W
4th S. The total area involved in this Rezone request is approximately
0.253 acres.
III. ANALYSIS
If approved the request will result in changing the zone for the parcel
from Community Business Center (CBC) to High Density Residential
1 (HDR1). The request would require the Commission and City
Council to review the proposal against one set of criteria, for the
request to rezone. Below, staff has provided all the criteria listed by
Ordinance No. 1200 (Development Code) that are required to be
addressed, followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
A pending change to the Comprehensive Plan, if approved
for this area, would make the proposal in compliance with
the Comprehensive Plan.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
Water and sewer capacity can service the parcel. Added traffic for this parcel could stress the
existing public streets.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.

d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.

e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
The area has not had changes.
f. Meets the requirements of the Development Code.

IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the change to 376 W 4th S
from Community Business Center (CBC) to High-Density Residential 1 (HDR1) if the Commission finds
that the proposed request is compatible with the surrounding area or in the best interest of the
neighborhood and the community.
