On March 21, 2008, Kurt Roland of Schiess and Associates, presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Preliminary Plat for PineBrook Estates Division 2.. 2. On May 1, 2008, Kurt Roland, and Curtis Ferney, developer, presented to the Rexburg Planning & Zoning Commission the Request for approval of the Preliminary Plat for Pine Brook Estates Division 2. Dan Hanna motioned to recommend for approval to City Council the preliminary plat for Pine Brook Estates Division 2, to include that lot 12 block 3 be addressed for connectivity, that there be a privacy barrier from the highway on the east and the west, and that lots along the highway be buffered by landscaping, that lots 1 through 4 of block 1 be included in a setback buffered landscaped area along 12ffi West, that the connectivity of the 2 cul-de-sacs on Larch Drive and on Castle Pines be addressed, that the street name issues be addressed, and that all other recommendations stated in the staff reviews be addressed. On May 21, 2008 City Attorney Zollinger and Planning and Zoning Administrator Leikness reviewed some of the history indicating the road alignment was not decided in the discussions; however, the developer was asked to connect the streets to avoid the cul-de-sac due to snow removal issues. This Particular cul-de-sac was removed and the road was moved to a different location causing a change in the road alignment. Council Member Schwendiman reviewed the two possibilities for Block 7 and Block 6 and how they interface with Pine Brook No. 1. Council Member Mann moved to approve Pine Brook Estates Division 2 as originally shown tonight with the double cul-de-sac option submitted in the original Preliminary Plat drawings dated April 14, 2008; m Council Me Schwendiman seconded the motion; Discussion: City Attorney Zollinger explained the developer needs to meet with the homeowners to clear up the concerns with the cul-de-sacs. Mayor Larsen suggested having the homeowners, neighbors from Mcjon Lane, the developer and City Staff me city influence to resolve the issues surrounding the cul-de-sacs and street alignment. et outside Mike Mitchell from McJon Lane voiced a desire to be part of themeeting. He wanted to discuss the issue of the additional traffic on Mc on Lane. He asked about the length of the northeast corner. City Attorney Zollinger said it is not a cul-de-sac according to city standards. City Attorney Zollinger explained he did not think traffic would impact McJon Lane because people take the course of least resistance. Some traffic will go down McJon Lane. Public Works Director John Millar said curbing and 34 foot half road width on the south side will be added to McJon Lane by the developer. Council Member Mann reiterated the City's commitment to the neighbors to maintain the two cul-de- sacs. Council Member Stout explained he feel this is treating people differently. It is giving something to one group of people and not extending the same courtesy to another group that could be affected by this development. On June 25, 2008 Kurt Roland of Schiess &Associates, representing Curtis Fenney, presented to the Rexburg Planning &Zoning Coordinator a Request and Application for a Final Plat for Pinebrook Estates Division 2. 2. On August 7, Kurt Roland presented to the Rexburg Planning & Zoning Commission the Request for approval of the Final Plat for Pinebrook Estates Division 2. Dan Hanna motioned to recommend approval to City Council of the final plat for Pinebrook Estates Division 2, with the condition that all lots fronting 12`'' West will have no access onto 12'h West, and requiring that the Development Agreement with the city be in place prior to the final signing of the plat. Ted Hill seconded the motion. There was a brief discussion with John Millar on the proposed development's water and sewer lines, which will be formally addressed in their Development Agreement with the city. None opposed. Motion carried. 3. Council Member Stevens asked about street widths: 68 foot wide streets and 100 foot cul-de-sacs. Mayor Larsen reviewed the berm across the front of the development. He asked about fencing. There will not be any fencing along 12th West; however, some fencingapplications make sense. Curtis Ferney said the berm along 12th' West would be better than a fence fit is done correctly. Mayor Larsen asked if fencing was a requirement in the city's subdivision ordinance. In some applications it would really make sense. Public Works Director Millar was not aware of a fencing requirement. Council Member Stevens indicated a berm would look very nice if done correctly. Council Member Stevens moved to accept Pinebrook Estates Division 2 Final Plat; Council Member Schwendiman seconded the motion; Discussion: Planning And Zoning Administrator Leikness requested adding: subject to the conditions recommended from Planning and Zoning (with the condition that all lot fronting 12`6 Nest will bave no access onto 12`h best, and requiring that the Development Agreement with the city be Zn place pyo, to the final signing ofthe plat) and Council Member Stevens said it would be noted on the plat. Curtis Ferney added it would be noted on the plat plus CCR's and bylaws would be noted on the plat; Council Member Stout asked if the berms and development agreement would be documented? Public Works Director Millar said the location of the berm will be noted on the plat. The structural requirements and payment method for the berm will be in the development agreement. 12th West access restrictions would be in the development agreement. All voted aye, none opposed. The motion carried.
