University District
11.1 Applicability
The provisions of this Chapter shall apply to all areas within the city and area of city
impact which are zoned University District as described in section 3.1 of this ordinance. To the
extent that the provisions of this Chapter conflict with any other provisions of the Rexburg
Zoning Ordinance, the provisions set forth in this chapter shall govern with respect to the
University Zone.
11.2 Land Use
Due to the unique nature of the University District, uses allowed in the district pursuant to
section 3.20 hereof shall include all uses and activities relating to:
A. Instruction
B. Activities relating to instruction
C. Church services and worship related activities
D. Student activities including recreation and sports
E. Student housing
F. Agriculture and farming activities
G. Food services
H. Retail sales such as those conducted by the University Book Store
I. Police services
J. The offering of medical care
K. Television and radio broadcasting
All buildings, uses, and activities associated with the above defined uses shall be considered
permitted uses in the University District. All other uses and activities associated with the purpose
and related operation of BYU - Idaho (hereinafter referred to as `University') shall be considered
conditional uses.
11.3 Parking
A. Findings
The City hereby finds that:
A. The University is a pedestrian type campus in which a majority of students
come from areas beyond the surrounding community and live in student
housing near the campus. Many students do not have cars. Campus
facilities, programs, and activities are structured to enable and to encourage
students to walk to campus and to move about campus without the use of
motor vehicles
B. Parking facilities in the University District should be constructed as to size,
location and use in a manner that will:
a. Adequately serve the needs of students, faculty and staff,
and the general public.
b. Assure that traffic does not congest the streets and arterials
leading to the Campus.
C. Discourage the use of on -street parking in neighboring
residential areas.
d. Promote and preserve the pedestrian nature currently
existing on the BYU - Idaho campus.
C. Encourage student pedestrian traffic to the campus
f. Discourage the movement of vehicular traffic to the campus
from local housing units during peak traffic times.
i3) The University campus is unique in its nature as to those who visit, work
and attend the University. Parking on the campus should be located in a
manner which will serve the needs of invitees to the campus. Because of its
unique nature, the University campus should be considered as one parcel.
All buildings, playing fields and other structures on the Campus should be
deemed served by all parking lots on campus, wherever situated. The
campus as a whole is served by all public streets adjacent to and running
through the campus as well as private roads and streets owned and
maintained by the University.
(4) The city hereby recognizes and adopts the findings of the BYU-Idaho
Campus Parking Study conducted by Wilbur Smith Associates dated _
, 2002.
B. The construction and use of off street parking in the University District shall be
pursuant to the provisions of Chapter 5 hereof; provided, the following provisions
of this chapter shall apply in the University District. To the extent that the
provisions of this Chapter conflict with any other provisions of the Rexburg
Zoning Ordinance, the provisions set forth in this chapter shall govern with respect
to the University District.
(1) Distance for Private Off -Street Parking
Required off-street parking shall not be required to be located within two
hundred feet (200') of the primary entrance of any building or structure.
(2) Common Parking Facilities for Joint and Mixed Uses
Common parking facilities for joint and mixed uses as described in section
5.3 of this ordinance is hereby allowed and encouraged in the University
District. The following additional provisions to section 5.3 hereof shall
apply with respect to joint use parking in the University District:
a. The written agreement described in section 5.3 B (3) authorizing
joint use of parking facilities shall include information which
demonstrates that the parking facility proposed to be considered for
joint use, will lessen the demand for other parking facilities located
in the University District. Any joint use parking facility agreement
shall not require a showing of "no substantial conflict in the
principal operating hours" of the various buildings, structures or
uses for which the joint use of parking is proposed.
b. Any parking facility proposed for joint use shall not be required to
be within two hundred feet (200) from the primary entrances of
buildings or structures which are served by such joint use parking
facility.
(3) Required Parkin for Land Uses
The minimum number of parking spaces to be provided in the University
District pursuant to this ordinance shall be as listed in table hereof.
Proposed uses not listed shall be subject to section 5.8 of this ordinance.

The University shall not be required to provide the minimum parking
spaces required in subsection 11.4 B. (3) and table hereof
upon a showing by the University that a current parking space to invitee
ratio shall not be greater than one space for each _ invitees. In
determining the ratio for this subsection, all parking spaces located upon
the University Campus together with all on -street parking located on the
campus side of any street abutting the campus shall be included. The term
`invitee' shall be defined as the sum of.
A. Currently enrolled students at the University
B. All part-time and full-time faculty at the University
C. All University staff and administrative personnel
