Note: 1. When an application has been submitted, it will be reviewed in order to determine compliance with
application requirements. It will not be accepted if it is not complete. A hearing date will be
scheduled only after an application has been accepted as complete.
2. A formal traffic study will be required for a retail sales area more than 75,000 feet; Schools for
more than 100 students; Apartment complex with 50 apartments or more.
3. Before annexation, the person or firm applying for annexation will agree to certain things: Curb and
gutter, streets, signaling, water and sewer, property sizing and location.

Additional Submittal Requirements
The City of Rexburg requires the following information to be submitted to the City Clerk for
every application for annexation:
1. Current Vicinity Map. (8 '% x 11 ") at 1 " = 300' scale, showing location and current
zoning of the property. Map is available from the City Planning and Zoning Office.
Please indicate the location of your property on the map.
2. Land Description. Attach a description of the actual property which you wish to
have rezoned or annexed on a separate page. All land descriptions must be certified
by a land surveyor registered in the State of Idaho.
A. Description shall mathematically close.
B. Descriptions shall be provided for the perimeter of the total area for which
annexation is being requested; and for each zone (separate zoning
classification) within said request. All zone descriptions shall correspond to
the perimeter description. Descriptions shall identify a basis of bearing based
upon two (2) known points from which the descriptions are based.
C. Descriptions provided may be required to be modified by the applicant to
include adjacent roads, canals, ditches, rivers, creeks, etc. as may be
identified by the Public Works Department.
D.
3. Photographs. Photos of existing site conditions.
4. Affidavit of Legal Interest. NOTE: No application will be accepted or processed
without this form.

The above entitled matter came on regularly for hearing on the 1451 day of March,
2000, pursuant to an order of the court fixing the time of hearing thereof, and proof being made
to the satisfaction of the court that due and regular notice of the time and place of hearing said
Petition has been given in the manner and for the time required by law and by order of the court,
and the court having considered the Petition for Summary Administration of Testate Estate
pursuant to Idaho Code, Section 15-3-1205, and heard the proofs, both oral and documentary,
now finds:
1. On June I" , 1968, in the city and county of Salt Lake, and in the state of Utah,
the Decedent and Joy Huskinson were married, and thereafter continued to live together as
husband and wife until the death of Decedent.

2. During coverture and while living together as husband and wife, they did, by
their joint efforts, labors and services in the acquirement of property as husband and wife,
acquire title to the hereinafter described property; and said property was the community property
of the Decedent and Decedent's surviving spouse.
3. Decedent had no children.
4. No last Will and Testament of the decedent has been found, after diligent
search and inquiry has been made by decedent's spouse and her children by a prior marriage.

8. The court finds that said step -children have never been adopted by the
decedent and there has never been established a parent child relationship between said decedent

and said step -children, and therefore, are not heirs at law of the decedent.
9. The court further finds and concludes as a matter of law that such property and
all interest of said Decedent therein at the time of death passed to Petitioner as the surviving
spouse and as his sole heir at law, subject to any and all indebtedness, if any there be, that might
be a claim against Decedent's estate.
10. The Court further finds that an Inventory was filed with the Court.
NOW THEREFORE, BY REASON OF THE LAW AND THE PREMISES, IT
IS HEREBY DETERMINED, ADJUDGED AND DECREED:
1. That due and legal notice of the filing of the Petition in this matter, and of the
time and place of hearing same, has been given, and
2. That the hereinafter described property and all of the Decedent's interest
therein at the time of death passed to the said Joy Huskinson, surviving spouse, by right of
descent and succession, and said surviving spouse became, and is hereby adjudged and decreed
to be, the sole owner of such property in fee simple by right of such descent and succession, and
record title is hereby decreed and established, subject to any and all indebtedness, if any there be,
that mig ht be a claim against Decedent's estate, in the said surviving spouse, Joy Huskinson, to
that certain property described as follows:
All such property as may not now be known and is hereafter discovered, and the
following real and personal property:
(a) The following described real property located in Madison County, Idaho, to -
wit:
