Presentation: New Employee: Scott Chapman - Animal Shelter/Ordinance Officer Mayor Merrill asked new city employee Scott Chapman to introduce himself. Mr. Chapman said he grew up in St. Anthony, Idaho before moving to Parker, Idaho 11 years ago. He has worked at the Juvenile Correction Center for 19 years. He and his wife have four children. He is excited to work for the City of Rexburg and looks forward to his new responsibilities. Mayor Merrill said Jim Lawrence has been serving on the Traffic and Safety Committee; however, he is recommending Mr. Lawrence serve on the Planning and Zoning Commission. He asked Mr. Lawrence to introduce himself. Mr. Lawrence said he has lived in Rexburg for the last eight years. He is a Civil Engineer Professor at BYU-Idaho University. Before, working for BYU-Idaho he worked for the City of Tooele County, Utah as the Civil Engineer Director. Mr. Lawrence said he enjoys living in Rexburg and desires to serve the community. Mayor Merrill mentioned Mr. Lawrence will be replacing Steve Oakey on the Planning and Zoning Commission. Mr. Oakey’s term on the commission has expired. Council Member Mann: M.E.P.I. · Legacy Flight Museum · Planning & Zoning Council Member Mann reported the Planning and Zoning Commission has been busy reviewing the Comprehensive Plan Map. He commended Planning and Zoning Administrator Parkinson for his leadership in Planning and Zoning. He also looks forward to working with Mr. Lawrence. Some of the items considered at the last Planning and Zoning Meetings will be before City Council at tonight’s meeting. Council Member Mann reported the Legacy Flight Museum has not met since June and M.E.P.I has not met. B. Council President Busby: Cultural Arts/Museum · School Board · M.U.S.I.C. Council President Busby reported he spoke with Cultural Arts Director Platt regarding upcoming events and was informed of the following: Starting September 8, the Museum of Rexburg: Home of the Teton Flood Exhibit will be open 11 AM-3 PM, Monday-Saturday. Located in the lower level of the Tabernacle Civic Center (51 N. Center St.) the museum is the place to enjoy local history…and to make your own. We are actively collecting memories of the Teton Dam flood to add to an exciting new project. Where were you on June 5, 1976?  “We were driving into Rexburg after returning from our honeymoon, and saw that the road to our house was blocked off. We told the officer at the barricade that we lived down that road. He replied, “not anymore.” Please email YOUR flood experience to museum@rexburg.org. Council President Busby reported on the Romance Theater remodel. The electrical work is almost complete and the drywall will be installed next week. The remodel is scheduled to be completed in November and the grand opening of the theater is being planned for November 27th. He also reported the Octuber Fest is scheduled for Saturday, October 17th at the Madison County Fair Grounds. There will be all things potato with great food, entertainment, contests, and activities. The Nights at the Museum Event will begin in October at the tabernacle. Council President Busby said the School Board will meet tomorrow. They did have a successful start of school. The M.U.S.I.C group has not met. C. Council Member Walker: MYAB · Emergency Services · Traffic & Safety Council Member Walker reported the Mayor’s Youth Advisory Board held their first meeting of the year with an Opening Social. The Emergency Services Board has not met; however, he did visit with Fire Chief Child and was informed there are still several trucks stationed at wildland fires. A medical trailer and ambulance are stationed at a fire in Oakley, Idaho. The tender truck was returned because there wasn’t personnel available to operate the truck. The asphalt between the fire station and training building is being replaced. The concrete in front of the fire bay is also being replaced. D. Council Member Johnson: Trails · Beautification · Rexburg Free Clinics Board Council Member Johnson reported she will be meeting with Economic Developer Torres and a BYU-Idaho student who will be completing his senior project on city trails. The Trails Committee will be meeting on Tuesday, September 29th to discuss the addition of bike paths throughout the city. The Beautification Committee will be assisting the city with the fall clean up. Mayor Merrill mentioned with the recent windstorm, the city’s wood pile near the Animal Shelter is open to residents until September 21st to deposit tree limbs. Council Member Johnson reported she attended the Rexburg Free Clinics Board meeting last week. They discussed different advertisement options to inform residents of the services they provide. The clinic also has a Facebook page. Mayor Merrill asked if the clinic offers Covid-19 testing. Council Member Johnson said the clinic is not equipped to handle Covid-19 cases. E. Council Member Flora: Parks & Recreation · Urban Renewal Agency · GIS Oversight Council Member Flora reported she drove by the new baseball quad and noticed the fence and light poles have been installed. She asked for an update of the work still needing to be completed. Mayor Merrill replied the construction work is coming along; however, they are behind in planting the grass. The grass seed will be pre-germinated before planting to speed up the growth process. Council Member Flora reported the construction on the dog park continues to move forward. She said she had applied for a grant for the Rotary Park upgrades but due to other construction being delayed at that park, a final decision to upgrade the Rotary Park has not been made. She will review the city’s Park Plan with the CHC Foundation’s representative to determine if the grant funds could be used towards other park plans instead of the Rotary Park if the grant is awarded. Council Member Flora indicated the Recreation Department is considering changes to the Teton Dam Marathon 5K and 10K races due to the Covid-19 Pandemic; however, the full marathon will still be held. The Recreation Guide has been published and ready to distribute. She also reported the Urban Renewal Agency has not met. F. Council Member Wolfe: Airport Board · Golf Board · Police Council Member Wolfe reported he was unable to attend the meetings held by the Airport Board and Golf Board due to personal reasons. Mayor Merrill reported he attended the Golf Board meeting and they discussed keeping the Club House open during the winter months for business. Council Member Wolfe said the Police Department will be holding a Senior Staff meeting next week. Council Member Busby reported a City Council meeting is planned for October 21st. The City Council Members and Mayor will drive around the city to review and discuss city projects. Staff Reports: Finance: - Matt Nielson Finance Report Finance Officer Nielson reported the Finance Department is currently working on a Request for Proposal for new finance software. The city has been saving for the new software for about five years. There is a possibility funds from the State’s CARES Act could be used to pay for the new software. Finance Officer Nielson reviewed the Budget Summary Operating Expenditures Report. The Arts Department and the Romance Theater are low in expenditures; however, most of the construction expense for the theater will be processed in the next fiscal year. The expense forecast for Rexburg Rapids is indicating an operating loss of about $50,000. There will be a savings in utilities of about $12,000 this year for Rexburg Rapids. He said considering the pool was not opened to full capacity the savings in utilities was significant. Finance Officer Nielson mentioned the Street Repair Contracts expenses are high at 418% due to carry over from last year and the many street projects being completed this year.   Council Member Mann questioned the 74% in the State Taxes and Grants Funds. Finance Officer Nielson explained the reason that fund is low is due to a pending payment. Finance Officer Nielson reviewed the Cash and Investments Report. There has been a decrease in the total amount of the city’s investment due to street projects being completed. He said he found a municipal bond for the Twin Falls Library and the city purchased about $600,000 of that bond. The return on the bond is about 80 base points which is a substantial amount.  Finance Officer Nielson reviewed the Treasurer’s Expenditure Report. The revenues for the Golf Course Operations continue to be strong. He is forecasting a profit of about $15,000 at Teton Lakes Golf Course; however, there will be an operating loss at the Legacy Municipal Golf Course of about 60 to 70 thousand dollars. There was a lot of capital projects completed for both golf courses this fiscal year. Finance Officer Nielson mentioned the Sanitation Reserves are slightly over one million dollars. He said city staff has met with the Western Recycling regarding the city’s recycling program. After much discussion between the parties, they have decided to continue with the city’s recycling program. They determined the curbside program is the best way to capture most of the recyclable material. Council Member Wolfe asked if the changes to the contract for the golf courses increased the revenues. Finance Officer Nielson explained the increase in revenues will depend on the Golf Pro position. If the original proposal is present at the Golf Board and they recommended it to City Council and the proposal passes the city would receive about $19,000 additional funds. There will still be some negotiation with the original proposal.   Investment Policy Changes Deputy Finance Officer Miller reviewed the city’s Investment Policy Changes and explained the Cash and Investment Relationships graph.  Deputy Finance Officer Miller explained the recommended percentage changes and clarified even though the percentage for most of the investments will be changed to 100 percent doesn’t mean the city will invest 100 percent in those investments.  Deputy Finance Officer Miller reviewed the recommended verbiage changes in the investment policy.       Deputy Finance Officer Miller said city staff recommends a motion from City Council to adopt updated Investment Policy Resolution 2020-19 and make changes effective immediately.  Council Member Mann moved to approve Resolution 2020 – 19 Investment Policy for the City of Rexburg; Council Member Wolfe seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Flora None Council Member Johnson Council Member Mann Council Member Walker Council Member Wolfe Council President Busby The motion carried Public Works: - Keith Davidson Citywide Crosswalk Painting Bid Acceptance Public Works Director Davidson explained Precision Line Striping was the low bid; however, they withdrew from the project because of time constraints. He contacted Idaho Traffic Safety because they were the second low bid. Idaho Traffic Safety has agreed to take on the project upon City Council approval. CONTRACTOR/COMPANY NAME: BID AMOUNT:  Precision Line Striping $42,409.60  Idaho Traffic Safety $49,944.40  Superior Stripping $50,000.00  Straight-line Striping $83,147.75  APPARENT LOW BIDDER: Precision Line Striping   Council Member Johnson moved to approve the low bid of $49,944.40 from Idaho Traffic Safety for the Citywide Crosswalk Painting Project; Council Member Flora seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Flora None Council Member Johnson Council Member Mann Council Member Walker Council Member Wolfe Council President Busby The motion carried Public Works Director Davidson reported the concrete replacement project for the Fire Station will begin on Monday. The replacement of the asphalt behind the Fire Station in the alley way will begin the following Monday. There were flyers passed out to surrounding businesses informing them of the construction work and closure of the alley way by the Fire Station. Public Works Director Davidson said the light poles for the Pickle Ball Courts at Nature Park have been installed. The electrical work will soon be completed. Mayor’s Report: Mayor Merrill reported the lights at City Hall and other city buildings are being replaced with LED. The cost of the LED lights is being funded by a Rocky Mountain Power (RMP) grant. He recently signed another grant from RMP to fund a blower for the wastewater plant. Discussion regarding the operation and savings in power with the new blower. Mayor Merrill reported that he and Council Member Walker and Council Member Johnson met to discuss the new public message by the city regarding the COVID-19 Pandemic. The purpose of the new message is in support of East Idaho Health Department. Discussion about the number of active COVID-19 cases in Madison County. The new message will be printed on signs to distribute to businesses. Public Hearing 6:45 P.M. – Proposed Grant to the Idaho Department of Commerce for an Idaho Community Development Block Grant in the amount of $225,000 for Improvements to Rexburg Nature Park Rick Miller Project Manager and Developer with The Development Company explained the process to apply for a Community Development Block Grant from the Idaho Department of Commerce. When applying for a block grant two public hearings are required. The initial public hearing is to allow the public to comment or question how the grant funds will utilized. If the grant is awarded to the city a second public hearing is required to inform the citizens how the funds are being utilized. Mr. Miller said he and city staff met to review the city’s 10 year Park Plan to identify the highest priorities for the city’s parks. They identified that the restroom facilities at Nature Park need to be replaced and there needs to be Americans with Disabilities Act (ADA) connectivity within the park. He is going to apply for $225,000, the maximum amount of funds allowed for city parks. The grant will assist with the funding of two unisex restrooms, ADA connectivity, ADA parking, repairs to shelters, drinking fountains and benches. The total budget for the project is about $322,000. If the grant is awarded to the city, it will cover $225,000 of the expenses, the city will cover about $27,000 and the remainder of the cost will be through in-kind work completed by city. The grant application due date is Monday, September 21st and if the city is awarded the grant he will be notified by the end of November. Mr. Miller mentioned if the grant is awarded, an environmental study will be conducted which could take about 60 to 90 days to complete. The city should be able to begin construction next spring. He said the city is eligible to apply for the grant through the United States Department of Housing and Urban Development because of the city’s low to moderate income levels. Council Member Walker moved to approve the Proposed Grant to the Idaho Department of Commerce for an Idaho Community Development Block Grant in the amount of $225,000 for Improvements to Rexburg Nature Park; Council Member Johnson seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Flora None Council Member Johnson Council Member Mann Council Member Walker Council Member Wolfe Council President Busby The motion carried Items for Consideration: Resolution 2020 – 17 Comprehensive Plan Map Amendment for 264 & 280 E Main St #20-00601 from Low to Moderate Density Residential to Neighborhood Commercial/Mixed Use – Alan Parkinson Planning and Zoning Administrator Parkinson reviewed the city sponsored Comprehensive Plan Map amendment for 264 and 280 East Main Street from Low to Moderate Density Residential to Neighborhood Commercial/Mixed Use. Council Member Johnson asked for clarification regarding the Comprehensive Plan Map amendment without the zone change request. Planning and Zoning Administrator Parkinson replied the Residential Business District doesn’t have a Comprehensive Plan Map designation. City Attorney Zollinger explained eventually there will be a request to change the zone. Council Member Flora questioned if the Comprehensive Plan Map amendment is denied by City Council is there any consequences. Planning and Zoning Administrator Parkinson replied the challenge would be the city has a zone out of conformity.   RESOLUTION FOR AMENDING VISION 2020 REXBURG COMPREHENSIVE PLAN MAP Resolution No. 2020 - 17 WHEREAS, on the 16th day of September, 2020, the City Council for the City of Rexburg was duly convened upon notice properly given and a quorum was duly noted; and WHEREAS, in a Rexburg Planning and Zoning Commission meeting on the 3rd day of September 2020, the Planning and Zoning Commission held a public hearing, taking public comment for and against the proposal to amend the Comprehensive Plan Map. The public hearing ended with a recommendation of the proposed Comprehensive Plan Map change to City Council; and WHEREAS, in a subsequent City Council meeting on the 16th day of September, 2020, the City Council reviewed the findings from the Planning and Zoning Commission’s Public Hearing held on the 3rd day of September, 2020; and WHEREAS, a comprehensive plan is a living document; an ongoing planning participation effort by the citizens of the community is encouraged to ensure changing conditions meet the needs of the community; and WHEREAS, proposed changes to comprehensive plan map can change land use designations; and WHEREAS, the following approved Land Use designation changes to the Comprehensive Plan Map from Low to Moderate Density Residential to Neighborhood Commercial/Mixed Use at approximately 264 and 280 E Main St (20-00601) in the City of Rexburg, Madison County, Idaho and more particularly described as follows: Comprehensive Plan Map Amendment Legal Description: 264 East Main St: Commencing at the Northwest corner of Lot 4, Block 1, of the Rigby addition to the City of Rexburg, as per the recorded plat thereof, and running thence south 9.5 rods; thence east 5 rods; thence north 9.5 rods; thence west 5 rods, to the point of beginning. 280 East Main St: Commencing at the Northeast corner of Lot 4, Block 1, of the Rigby Addition to the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and running thence west 5 rods; thence south 10 rods, thence east 5 rods; thence north 10 rods to the point of beginning. The current zone has allowed residents to convert their home into businesses without changing the character of Main Street. The allowable uses in the Comprehensive Plan amendment would allow the property owner to change the character of area. There is a possibility a traffic study is needed. A plat will be required before moving forward with a project.    Council Member Wolfe moved to approve Ordinance No. 1236 the Rezone at approximately 220, 224, & 228 N 3rd W #20-00505 from Low Density Residential 2 (LDR2) to Medium Density Residential 2 (MDR2) Zone and consider first read; Council Member Johnson seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Flora None Council Member Johnson Council Member Mann Council Member Walker Council Member Wolfe Council President Busby The motion carried Resolution 2020 – 18 Idaho Gem Grant Application for CARES Act Recovery Assistance Consultant – Ted Hendricks ECIPDA Mayor Merrill explained the Idaho Gem Grant Application for the CARES Act Recovery Assistance Consultant. Ted Hendricks with East-Central Idaho Planning and Development Association (ECIPDA) has asked the city to be the sponsor for the grant. In order for ECIPDA to apply for the grant they need to have a sponsor. The amount of the grant is $24,000. The grant funds will be used to hire a consultant with expertise in the CARES Act Recovery Assistance. Council Member Flora asked about the city’s obligation besides being a sponsor. Mayor Merrill said there are no other city obligations concerning the grant application. IDAHO GEM GRANT APPLICATION Resolution No. 2020 - 18 WHEREAS, the City Council of Rexburg, Idaho is interested in the economic health of the community and its citizens; and   WHEREAS, the City Council of Rexburg, Idaho wishes to support and encourage appropriate efforts within the community that promote economic development of the community and the economic well-being of its citizenry; and   WHEREAS, the Idaho Department of Commerce is offering a program specifically designed to help rural Idaho communities implement economic development strategies/projects and,   WHEREAS, this program is entitled the Idaho Gem Grant Program   NOW, THEREFORE, BE IT RESOLVED, that the City Council of Rexburg, Idaho hereby supports and endorses an Idaho Gem Grant application for the CARES Act Recovery Assistance, Consulting Firm Acquisition project; BE IT FURTHER RESOLVED, that the City Council of Rexburg, Idaho designate the Development Company as its sub-grantee and administrative agent for this grant. PROCLAMATION No. 2020 – 04 September 17 – 23 as Constitution Week WHEREAS, September 17, 2020 marks the two hundred and thirty- third anniversary of the drafting of the Constitution of the United States of America by the Constitutional Convention; and WHEREAS, It is fitting and proper to accord official recognition to this magnificent document and its memorable anniversary and to the patriotic celebrations which will commemorate the occasion; and WHEREAS, Public Law 915 guarantees the issuing of a proclamation each year by the President of the United States of America designating September 17 through 23 as Constitution Week.
