PROPERTY LOCATION: Professional Plaza St & 242 E Main COMPREHENSIVE PLAN: Commercial CURRENT ZONING: Low-Density Residential 1(LDR1) PROPOSED ZONING: Community Business Center (CBC) SURROUNDING LAND USES: Professional Plaza: (North) – Mtn. America Call Center, Multi-family (East) – Single-family homes (West) – Commercial, a single-family home on south border (South) – Single-family homes, Abri Apartments AND ZONING: (North) – High-Density Residential 1(HDR1) (South, East) – Low-Density Residential 2 (LDR2), Mixed Use (MU) (West) – Mixed Use (MU) and Downtown District APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Zoning Map Revisions AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND The Professional Office Plaza was originally in the Professional Office Overlay and reverted to the LDR1 zoning when the Overlay was removed from the Development Code. II. SITE DESCRIPTION The Professional Plaza are located just south of the Mtn America Credit Union and their call center currently under construction on E Main Street. The total area involved in this Rezone request is approximately 3.30 acres. III. ANALYSIS If approved the request will result in changing the zone from Low- Density Residential 1 (LDR1) to Community Business Center (CBC). The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. The Commercial designation allows Community Business Center zoning. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. The parcels are already attached to city water and sewer for existing developed lots. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. There are no physical changes to the uses of the property at this time. e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. The areas have not had changes. f. Meets the requirements of the Development Code. These changes will bring the areas into conformance with their current uses. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the changes to the properties from Low-Density Residential 1 (LDR1) to Community Business Center (CBC) if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
