Dear Mr. Rodino,
I appreciate your letter concerning BLT Hymas Enterprises LLC. There is no question on the part of the City of Rexburg relative to the existence of the easement and the “interest” in
the sign. The question that appears to be unresolved is what portion of the sign constitutes the “interest”.
The City Sign Ordinance would likely disallow the sign if it is owned by someone other than the property upon which it is located. Off premise signs are regulated much differently than
On premise signs.
A review of the City records, as well as an inspection of the existing sign clearly indicates that the existing sign was owned jointly by the property where it is located and that the
property owned by BLT Hymas Enterprises LLC shares the sign pole with their sign being the portion hanging off the North side and the Mandarin property owners having ownership of the
portion on the South side of the pole.
As stated above, if that is not the case, there is likely a violation of the City Sign Ordinance, and no modifications to the existing sign would be allowed.
