AFFIDAVIT OF PUBLICATION

Madison and Fremont Counties
I, Rick Wallace, being first duly sworn, depose and say, that
I am the publisher of the STANDARD JOURNAL, a 5
times a week newspaper published 5 times a week in
Madison and Fremont Counties, Idaho; and I do solemnly
swear that the P&Z Commission of the City of Rexburg -
zone change at 814 N. Yellowstone Hwy., Rexburg, a copy
of which notice appears attached hereto, was published in the
regular and entire issue of said newspaper, and not in any
supplement issue, once each week thereof for two issues, the
first publication having been made on January 19, 2008 and
the last publication having been made on February 2, 2008.
Further, that said newspaper is one of general circulation in
said county; that it is a legal newspaper, conforming to legal
specifications under the Idaho Statutes; that it has at least two
hundred bona fide subscribers living within the county of
publication; and that it has been continuously and
uninterruptedly published in said county during a period of
seventy-eight consecutive weeks prior to the first publication
of the said notice

NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before
the Planning & Zoning Commission of the City of Rexburg, Idaho,
Thursday, February 7th, 2008 at 7:05 p.m., in the City Council
Chambers of the City Building at 12 North Center, Rexburg, Idaho,
regarding a zone change from Medium Density Residential One
(MDR1) to Community Business Center (CBC).
The city code governing this request is ORDINANCE No. 926
"DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO"
(ADOPTED FEBRUARY 16th, 2005) and Amended 7/06/2005;

Thesaid parcel is located at 814 N. Yellowstone Hwy in Rexburg,)
Madison County, Idaho, and more particularly described as follows:
Part of the South Half of the Southwest Quarter IS _ SW _) of Section
17, Township 6 North, Range 40 East of the Boise Meridian,
Madison County; Idaho described as follows:
Beginning at a point that is N.00°11'06"E. 1159.37 feet along the
section line and N.89°35'15"E. 420.47 feet from the Southwest
corner of said Section 17 and running thence N.89' 35'15"t. 432.74
feet thence S. 00'08'08"E. 495.01 tactic the South 1/64t1f'Ifrie'of
said Section 17; thence S.89'35'15"W.664.00 feet alongsd1d South
1/64thline to a point on a curve on the easterly right-of-way line of
U.S. Highway No.. 191; thence along said easterly rlght-of-way line
the following two (2) courses: (1) 432.89 feet along said curve to the
right, Curve Data: Delta = 13'24'25". Radius = 1850.00 feet, Chord
bearing= N.23'25'48"E. 431.90 feet; thence (2) N.30'10'04"E.
116.11 feet to the point of beginning. Parcel contains 6.383 acres.
At such hearing the Planning & Zoning Commission will hear all
persons and all objections and recommendations relative to such
proposed permit. The City Clerk will also accept written comments
at City Hall prior to 4:00 p.m. on February 061h, 2008.
This notice is given pursuant to the provisions of Section 67-6509 and
67-6511 Idaho Code, and all amendments thereof.
