BACKGROUND The City is sponsoring this zone change. 264 & 280 E Main are the only parcels in Rexburg zoned Residential Business District. The Professional Office Plaza was originally in the Professional Office Overlay and reverted to the LDR2 zoning when the Overlay was removed from the Development Code. The Grand Loop Area was partially zoned Technology Office Zone (TOZ) in August of 2005 with Ordinance 946. Two of the lots have been built on as commercial buildings, but no computer or technology businesses have located in this business park. These are the only TOZ lots zoned in the city. The Rexburg Development Code allows the Commission to make recommendations to the City Council regarding whether or not the property should or should not be rezoned based on the criteria found in section §1.04.020. II. SITE DESCRIPTION 264 & 280 E Main and the Professional Plaza are located just south of the Mtn America Credit Union and their call center currently under construction on E Main Street. Grand Loop is located just north of the Riverwood Townhomes on Trejo St. The total area involved in this Rezone request is approximately 11.82 acres. 264 & 280 E Main Professional Plaza Grand Loop III. ANALYSIS If approved the request will result in changing the zone for the parcels from Residential Business District (RBD), Low-Density Residential 2 (LDR2) and Technology Office Zone (TOZ) to Community Business Center (CBC). The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. Neighborhood Commercial/Mixed and Use and Commercial designation allow Community Business Center zoning. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. The parcels are already attached to city water and sewer for existing developed lots. Water and sewer would need to be determined for undeveloped lots in the Trejo Professional Park on Grand Loop Rd. c. The capacity of existing public services, including but not limited to, public safety services, Case No. 20 00347 Page 3 public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. There are no physical changes to the uses of the property at this time. e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. The areas have not had changes. f. Meets the requirements of the Development Code. These changes will bring the areas into conformance with their current uses. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the changes to the properties from Residential Business District (RBD), Low-Density Residential 2 (LDR2) and Technology Office Zone (TOZ) to Community Business Center (CBC) if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
