PROPERTY LOCATION: 53 & 55 E 1st N COMPREHENSIVE PLAN: Neighborhood Commercial/Mixed Use CURRENT ZONING: Mixed Use (MU) and Low-Density Residential 2 (LDR2) PROPOSED ZONING: Mixed Use (MU) SURROUNDING LAND USES: (North, West) – Planned Unit Development – Single-family homes (East) – Single-family homes and an approved 8-plex (South) – Law office, Commercial AND ZONING: (North) – Low-Density Residential 2 (LDR2) (South) – Central Business District (CBD) (East & West) – Mixed Use (MU) & Low-Density Residential 2 (LDR2) APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Zoning Map Revisions AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND The property at 55 E 1st N currently has an approved Conditional Use Permit for a duplex issued in April of 2013. Access for the existing duplex is shown on both lots. The lots are split for zoning designations, with the north approx. 111’ of the lots in Low-Density Residential 2 and the south approx. 164’ in Mixed Use (MU). The Applicant is requesting the lots be completely zoned to Mixed Use (MU) to take advantage of the density allowances. Right now, the Infill/Redevelopment requirements for adjacent zones would identify additional requirements for where a building could be placed. The property is also split by the Downtown District boundary. II. SITE DESCRIPTION The parcel is east of the Charles Place Planned Unit Development and west of the recently approved 8-plex called Ollie Manor. The total area involved in this Rezone request is approximately 0.524 acres. III. ANALYSIS If approved the request will result in changing the zone for the parcel currently split between Low-Density Residential 2 and Mixed Use to entirely Mixed Use. The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. Neighborhood Commercial/Mixed Use allows a zoning of Mixed Use. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. The current duplex is attached to city water and sewer. All storm drainage will have to be handled on site. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. Mixed Use (MU) would increase the density of these lots. e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. N/A f. Meets the requirements of the Development Code. Yes IV. STAFF RECOMMENDATION Staff recommends that the Commission take public testimony and determine if the proposed rezone to Mixed Use (MU) for 53 and 55 E 1st N can be approved, denied or approved with conditions if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community. Staff has reviewed the application and found it meets the requirements for rezone.
