§ 1.04.020 Zoning Map Revisions
AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The applicant is requesting to change the Zoning Map. This is a parcel adjacent to the railroad. The
property has an existing bulk dry fertilizer plant. The Applicant desires to increase the storage capacity
(square footage) of this plant. The plant is in the City’s Impact Area.
The Rexburg Development Code allows the Commission to make recommendations to the City
Council regarding whether or not the property should or should not be rezoned based on the criteria
found in section
§1.04.020.

II. SITE DESCRIPTION
The parcel is between S Yellowstone Highway on its east side and the
railroad to its west. The total area involved in this Comprehensive
Plan Map change request is approximately 5.8 acres.
III. ANALYSIS
If approved the request will result in changing the zone for the parcel
Community Business Center (CBC) to Light Industrial (LI). The
request would require the City Planning & Zoning Commission and the
County Commissioners to review the proposal against one set of
criteria, for the request to rezone. Below, staff has provided all the
criteria listed by Ordinance No. 1200 (Development Code) that are
required to be addressed, followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
Applicant is applying to change the Comprehensive Plan Map in addition to this rezone.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
All storm drainage will have to be handled on site.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.
Utilities cannot service the parcel; they are a long ways from this site.
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.
Increase of traffic on and off Yellowstone Highway. Potential odor with increase of production.
However, these nuisances will not bother the surrounding uses.
e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
There are no recent land use changes in this area.
f. Meets the requirements of the Development Code.
Community Business Center only allows for Household Storage as a permitted use, nor does it
allow this type of farm supply manufacturing. Light Industrial allows the sale of farm equipment
and supplies, as well as warehousing or storage services.
IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the change to property
from Community Business Center (CBC) to Light Industrial (LI) if the Commission finds that the
proposed request is compatible with the surrounding area or in the best interest of the neighborhood and
the community.
