PROPERTY LOCATION: 790 & 796 Barney Dairy Rd COMPREHENSIVE PLAN: Low to Moderate Density Residential CURRENT ZONING: Rural Residential 1 (RR1) PROPOSED ZONING: Low-Density Residential 2 (LDR2) SURROUNDING LAND USES: (North) – Agriculture (East) – Agriculture (West, South) – Single-family homes AND ZONING: (North) – Low-Density Residential 3 (South, West) – Rural Residential 1 (RR1) (East) – Low-Density Residential 1 (LDR1) APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Zoning Map Revisions AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND The applicant is requesting to change the Zoning Map. The North Hill Rd. neighborhood was recently annexed into the city. When it was annexed, some of the property owners currently had animals and wanted to keep that right, so the property was all rezoned Rural Residential 1. Kevin Kimball’s house was built too close to his property line. He wants to acquire enough of the Parker’s parcel to make him compliant with the required setbacks. The Parker’s lot is already too small of a lot for the Rural Residential 1 zone, due to their deeding the right of way for the road to the city. Also, the Comprehensive Plan Map designation chart for allowed zoning in Low to Moderate Residential, allows a minimum of an LDR2 zone. Since a lot line adjustment is anticipated, it was suggested Kevin rezone both his parcel and the adjacent Parker’s parcel. II. SITE DESCRIPTION The parcel is south of Barney Dairy Rd and east of North Hill Rd. The total area involved in this Comprehensive Plan Map change request is approximately 2.023 acres. III. ANALYSIS If approved the request will result in changing the zone for the parcel Rural Residential 1 (RR1) to Low- Density Residential 2 (LDR2). The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. Low to Moderate Density Residential allows a minimum of an LDR2 zone. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. They are already attached to city sewer. Water would need to be installed along Barney Dairy Rd. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. Low-Density Residential 2 (LDR2) would allow duplexes, increasing the density of these lots. e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. Annexation was completed of the N. Hill Rd. area in summer of 2019. f. Meets the requirements of the Development Code. Kevin is seeking to meet the side setbacks of the zone. His home is approximately 3’ from is north (side yard) property line. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the change to property from Rural Residential 1 (RR1) to Low-Density Residential 2 (LDR2) if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
