On March 28, 2017, Johnny Watson of JRW Associates, presented to the P&Z Coordinator an application and request for annexation and rezone for the property located at approximately 950 Barney Dairy Rad. The zone change request was from Rural Residential 1 (RR1) and Transitional Agriculture 1 to Low -Density Residential 2 (LDR2). 2. On March 28, 2017 the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for April 14 and April 28, 2017 A notice and map was posted on the property and sent to all property owners within 300 feet of the above mentioned properties. The notice and map were sent to those on the 2017 Taxing Districts List 3. On May 4, 2017 Johnny Watson, representing the WR Holdings (Brian Ball) presented to the Planning & Zoning Commission for the City of Rexburg the request for the Annexation and Rezone for property located at approximately 950 Barney Dairy Road, with the zone change request from Rural Residential 1 (RR1) and Transitional Agriculture 1 to Low Density Residential 2 (LDR2). Steve Oakey motioned to recommend approval to City Council of an Annexation and Rezone for property at approximately 950 Barney Dairy Road as specified, with the Zone change to be from Rural Residential 1 (RR1) and Transitional Agriculture 1 (TAG1) to Low Density Residential 2 (LDR2) for the specified property. Greg Blacker seconded the motion. There was discussion about possibly adding conditions. It was clarified that a future development would come before the Commission when it is at the plat stage. Mark Rudd said at this point we are giving the developer the opportunity to take the next step. Steve Oakey said his motion stands. The Chairman clarified the motion. Council President Smith reminded the City Council Members that they were waiting for the LDR1 to be mapped. The buffer has been placed to allow at least the minimum lot size in LDR1. The developer was not prepared to place the road there yet. Council Member Flora was concerned about the corner lot close to the road. There is not sufficient room to go beside the corner lot. A road in the current plan is not planned to go anywhere. The current proposal from the City's Public Works Department is this section of the road would become the beginning of a bicycle path. Council Member Mann moved to approve BILL 1160 annexation and zone change and consider it on its third reading from Rural Residential One (RRI) and Transitional Agriculture One (TAG1) to Low Density Residential One (LDR1) and Low Density Residential Two (LDR2) for property in the Impact Area for the City of Rexburg; Council Member Wolfe seconded the motion; Council President Smith asked for a vote: Those voting ave Those voting nay Council President Smith None Council Member Flora Council Member Mann Council Member Wolfe Council Member Benfield Council Member Busby The motion carried
