December 2nd, 2019, A Ready team meeting was held with City Staff regarding development at 669 Pioneer Rd. identifying a need for both a Comprehensive Plan Map change and a Rezone. 2. December 5th, 2019, An application was submitted by the City of Rexburg through the Public Portal for Comprehensive Plan Map change from Commercial to Neighborhood Commercial/Mixed Use. A check was submitted for the incorrect amount. 3. December 11th, 2019, Fees were paid. 4. December 12th, 2019, During reviews, it was determined the ownership listed on the application did not match the ownership of the land. 5. December 16th, 2019, An Affidavit of Legal Interest was received from Morgan Peterson, the owner of the Pioneer Village Mall LLC. 6. December 18th, 2019, Notice was sent to the newspaper to be published on December 27th, 2019, and January 10th, 2019. 7. January 2nd, 2020, Notice was mailed to property owners within 350’ of the subject property. 8. January 7th, 2020, Staff Review Summary was sent to the Applicant and Owner listed on the application. 9. January 9th, 2020, Notice was posted on the property. 10. January 16th, 2020, Val Christensen presented the application for the Comprehensive Plan Map Amendment to the Planning & Zoning Commission. 11. 6:35PM – Val Christensen – 669 Pioneer Rd – Comprehensive Plan Map change from Commercial to Neighborhood Commercial/Mixed Use (19-00752). The request is to add housing to a commercial area. (action) Val Christensen – He is representing Ray Peterson and his family, who own the strip mall on Pioneer Rd. near the intersection of Pioneer Rd. and S. Yellowstone Hwy. Their request is to change the Comprehensive Plan and rezone the property with the purpose of putting a residential piece on this property. A survey has been completed over a three-month period and the conclusion is the parking is only being used at 50% of capacity. There is plenty of parking for this reques t before the Commission tonight. In the area to the North, there is neighborhood commercial/mixed use; this is the designation being requested. For the apartments that went in to the northeast, the developer came in and changed the Comprehensive Plan from neighborhood commercial/mixed use to moderate to high density residential. Chairman Rory Kunz asked if the Petersons are aware of the roundabout that is planned for this area. How will this impact parking? Val answered the Petersons are aware of the roundabout. Val has transposed the new plans for the roundabout and presented a parking lot plan to the city; no parking is lost with the plan Val has proposed. Vince Haley asked if anything would be torn down. Val showed an area between the two entrances that will have enough room for a small building. A drive aisle will still be able to go around the building. John Bowen asked how many commercial locations are on the property right now? There are more than six commercial locations and they will remain. Staff Report: Alan Parkinson – Ray Peterson has submitted a site plan to Staff for review. Staff’s biggest concern was adequate parking. The site plan shown to staff showed adequate parking, adequate buffering and the flow of traffic worked well. Staff has no concerns at this time. Tawnya Grover asked if there would be concerns with the parking if the uses change. One of the main concerns was with a majority of restaurants in this area, which may provide some parking changes. You could possibly restrict the number of restaurants in the commercial units. Stephen Zollinger said Alan was jumping ahead of the Comprehensive Plan Map change and the rezone before the Commission tonight by talking about the site plan. It is good to know that the appl icant has shown one feasible project. He focused the Commission on whether or not a Mixed Use would be a good fit for this area. Vince Haley asked if there was anywhere in town that is a Mixed Use project like the idea of Mixed Use that is being presente d tonight? Stephen Zollinger responded, North Point and Hemming have mixed use components. The uses would not be stacked but would exist on the same parcel. Melanie Davenport asked if the Commission wants the housing. In other areas, we wanted the commercial in front and the housing in back. For the requests tonight, Alan suggested the need to focus on the proposed use. Chairman Rory Kunz reminded the Commissioners, their decision should be based on the use and not the location of buildings. Chairman Rory Kunz asked the Commissioners if they had any conflicts of interest or had been approached by any parties relative to this particular subject. If you believe your prior contact with respect to this subject has created a bias, you should recuse yo urself, otherwise at this time please indicate the nature of your conversation or contact. City Council Meeting February 5, 2020 A. Resolution 2020-02 Comprehensive Plan Map Amendment (19-00752) 669 Pioneer Rd from Commercial to Neighborhood Commercial/Mixed Use – Alan Parkinson RESOLUTION FOR AMENDING VISION 2020 REXBURG COMPREHENSIVE PLAN MAP Resolution 2020 - 02 WHEREAS, on the 5th day of February, 2020, the City Council for the City of Rexburg was duly convened upon notice properly given and a quorum was duly noted; and WHEREAS, in a Rexburg Planning and Zoning Commission meeting on the 16th day of January, 2020, the Planning and Zoning Commission held a public hearing, taking public comment for and against the proposal to amend the Comprehensive Plan Map. The public hearing ended with a unanimous vote to recommend the proposed Comprehensive Plan Map change to City Council; and WHEREAS, in a subsequent City Council meeting on the 5th day of February, 2020, the City Council reviewed the findings from the Planning and Zoning Commission’s Public Hearing held on the 16th day of January, 2020; and WHEREAS, a comprehensive plan is a living document; an ongoing planning participation effort by the citizens of the community is encouraged to ensure changing conditions meet the needs of the community; and WHEREAS, proposed changes to comprehensive plan map can change land use designations; and WHEREAS, the following approved Land Use designation changes to the Comprehensive Plan Map from Commercial to Low to Neighborhood Commercial/Mixed Use at approximately 669 Pioneer Rd (19-00752) in the City of Rexburg, Madison County, Idaho and more particularly described as follows: Comprehensive Plan Map Amendment Legal Description: 4 | P a g e Lot 4, Block 1 of the Pioneer Village INST. NO. 317999; part of SE ¼ of Section 25, Township 6 North, Range 39 East, B.M., Rexburg, Madison County, Idaho. WHEREAS, the changes shown on the Comprehensive Plan Map dated February 5, 2020 have been approved by the City Council; NOW THEREFORE, by resolution duly adopted on the date first above written, be it resolved by the Mayor and the City Council the following: The City of Rexburg does hereby accept and adopt the said Comprehensive Plan Map Land Use Designations in the City of Rexburg Vision 2020 Comprehensive Plan. Val Christensen said he is representing Ray Peterson who is the owner of the strip mall on Pioneer Road near the intersection of Pioneer Road and South Yellowstone Highway. He explained the reason Mr. Peterson is requesting the Comprehensive Plan Amendment from Commercial to Neighborhood Commercial/Mixed Use is to be able to add another building onto the property. The developer is trying to target the student housing market in this area. The apartment will not be single student housing it will be community housing. Mr. Christensen explained city staff completed a parking evaluation. The amount of parking stalls being used are at 50% capacity. There will be sufficient parking to 5 | P a g e accommodate the change to Neighborhood Commercial/Mixed Use. He mentioned sever al developments throughout the city with the same zone being requested. Planning and Zoning Administrator Parkinson said the property is contiguous to the type of zone being requested. Council Member Mann mentioned some of the Planning and Zoning Comm issioners expressed concerns with setting a precedence with allowing this type of amendment to the Comprehensive Plan of using the parking lot to build a building. The commission emphasized this type of change would be reviewed on a case-by-case basis. Council Member Wolfe moved to approve Resolution 2020-02 Comprehensive Plan Map Amendment (19-00752) 669 Pioneer Rd from Commercial to Neighborhood Commercial/Mixed Use; Council Member Flora seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Flora None Council Member Johnson Council Member Mann Council Member Wolfe Council President Busby The motion carried
