HomeMy WebLinkAboutResolution 2020 - 04 Amending Comp Plan Map 814 N Yellowstone to Low-Mod Density Res/ RESOLUTION FOR AMENDING VISION 2020 REXBURG COMPREHENSIVE PLAN MAP Resolution No. 2020 - 04 WHEREAS, on the 4th day of March, 2020, the City Council for the City of Rexburg was duly convened upon notice properly given and a quorum was duly noted; and WHEREAS, in a Rexburg Planning and Zoning Commission meeting on the 20th day of February, 2020, the Planning and Zoning Commission held a public hearing, taking public comment for and against the proposal to amend the Comprehensive Plan Map. The public hearing ended with a unanimous vote to recommend the proposed Comprehensive Plan Map change to City Council; and WHEREAS, in a subsequent City Council meeting on the 4th day of March, 2020, the City Council reviewed the findings from the Planning and Zoning Commission’s Public Hearing held on the 20th day of February, 2020; and WHEREAS, a comprehensive plan is a living document; an ongoing planning participation effort by the citizens of the community is encouraged to ensure changing conditions meet the needs of the community; and WHEREAS, proposed changes to comprehensive plan map can change land use designations; and WHEREAS, the following approved Land Use designation changes to the Comprehensive Plan Map from Commercial to Low to Moderate Density Residential at approximately 814 N Yellowstone Hwy (19-00778) in the City of Rexburg, Madison County, Idaho and more particularly described as follows: Comprehensive Plan Map Amendment Legal Description: North Property: Beginning at a point that is N.00°11'06"E. along the section line 1159.37 feet and N.89°35'22"E. 401.04 feet from the Southwest corner of Section 17, Township 6 North, Range 40 East Of The Boise Meridian, said point being on the Easterly right of way of Yellowstone U.S. Highway 33; running thence N.89°35'22"E. 162.17 feet to the West line of Kenneth Square Condominium Development, City Of Rexburg, Madison County, Idaho; thence S.00°08'08"E. along said West line 213.40 Feet to the North right of way line of Ella Lane; thence Westerly along said North right of way line the following three (3) courses: (1) S.89°35'15"W. 88.06 feet to a point of curve with a radius of 151.00 Feet and a chord bearing N.78°42'00"W. 61.31 Feet; (2) thence to the right along said curve 61.73 feet through a central angle of 23°25'29"; (3) thence N.66°59'16"W. 94.06 feet to said Easterly right of way line of Yellowstone U.S. Highway 33 said point being on a non-tangent curve with a radius of 1223.24 feet and a chord bearing N.28°06'50"E. 86.16 feet; thence Northerly along said Easterly right of way line the following four (4) courses: (1) to the right along non-tangent curve 86.18 feet through a central angle of 04°02'11"; (2) thence N.30°08’00"E. along said Easterly right of way line 92.05 feet; (3) thence N.88°34'30"W. 19.38 feet; (4) thence N.30°08'00"E. 9.25 feet to the point of beginning. Subject To: Existing Easements Of Record. Containing 0.917 Acres South Property: Beginning at the Southwest corner of Section 17, Township 6 North, Range 40 East of the Boise Meridian; running thence N.00°11'06"E. along the section line 1159.37 feet; thence N.89°35'27"E. 563.21 Feet; thence S.00°08'08"E. 281.40 feet to the true point of beginning, said point being on the West line of Kenneth Square Condominium Development, City Of Rexburg, Madison County, Idaho; running thence S.00°8'08"E. along said West line 213.60 feet; thence S.89°35'15"W. 360.27 feet to the Easterly right of way line of Yellowstone U.S. Highway 33; thence N.19°07'59"E. along said Easterly right of way line 206.59 feet to a point on a non-tangent curve with a radius of 1223.24 feet and a chord bearing N.21°01'20"E. 80.62 feet; thence to the right along said non-tangent curve 80.64 feet through a central angle of 03°46'37" to the Southerly right of way line of Ella Lane; thence Easterly along said Southerly right of way line the following three (3) courses: (1) S.66°59'16"E. 95.83 feet to a point of curve with a radius of 219.00 feet and a chord bearing S.78042'00"E. 88.91 feet; (2) thence to the left along said curve 89.54 feet through a central angle of 23°25'29"; (3) thence N.89°35'15"E. 87.73 feet to the true point of beginning. Subject To: Existing Easements Of Record. Containing 1.685 Acres WHEREAS, the changes shown on the Comprehensive Plan Map dated March 4, 2020 have been approved by the City Council; NOW THEREFORE, by resolution duly adopted on the date first above written, be it resolved by the Mayor and the City Council the following: The City of Rexburg does hereby accept and adopt the said Comprehensive Plan Map Land Use Designations in the City of Rexburg Vision 2020 Comprehensive Plan.
