circumstances of each proposed conditional use and shall find adequate evidence to show that the proposed use will:
I . Constitute a conditional use as established in Table l, Zoning Districts, and Table 2, Land Use Schedule'
z. Be in accordance with a specific or general objective of the city's comprehensive Plan and the regulations of
this Ordinance.
3. Be designed and constructed in a manner to be harmonious with the existing character of the neighborhood and
the zone in which the properry is located'
4. Not create a nuisance or safety hazardfor neighboring properties in terms of excessive noise or vibration,
improperly directed glare or heat, electrical interferen"", oaoi., dust or air pollutants, solid waste generation and
storage, hazardous materials or waste, excessive traffic generation, or interfbrence with pedestrian traffic'
5. Be adequately served by essential public facilities and services such as access streets, police and fire protection,
drainage structures, refuse disposal, water and sewer service, and schools. If existing facilities are not adequate, the
developer shall show that such facilities shall be upgraded sufficiently to serve the proposed use'
6. Not generate traffic in excess of the capacity orpuutic streets or access points serving the proposed use and will
assure adequate visibility at traffic access points'
7. Be effeciivety buffered to screen adjoining properties from adverse impacts of noise, building size and resulting
shadow, traffic, and Parking-g. Be compatible with the slope of the site and the capacity of the soils and will not be in an area of natural hazards

On October 77,2012, Stephen Zollinge4representing Madison Memodal Hospital,
presented to the City of Rexburg Planning & Zonng Coordinator a request and application
fot a Conditional Use Permit to allow an Assisted and ResidennalCarcFacility. TLe properry
is located at 41,0 West 1't North.
On October 17,2072, the City Cletk sent the Notice of Public Hearing to be published in
the local newspaper on October 76 and October 27,201,2. A notice -as posted on the
property and sent to all property owners within 300 feet of the above mentioned property.
On November 1, 2}l2,David Thueson and StephenZollingerpresented to the planning &
Zonng Commission for the City of Rexburg, the request for a Conditional Use permit to
allow an Assisted and Residenttalcarc Facility at 41,0 rwest i.'t Nonh.
M^ry Ann Mounts motioned to recommend to City Council approval of a Conditional Use
Permit to allow an Assisted and Residenttal Care Facility at 410 West 1" North, to include
tle' Standards Applicab ,, Section 6.1,28 in the Development
code ordinance No. 1026. scott Ferguson seconded the motion.
Discussion on whether the fence should be a condition. The facitty will be required to build
a 6-foot ptivacy fence. Scott Ferguson and Mary Ann Mounts did not feel the need to
include the fence as a condition.
None opposed. Motion carried.
On November 28, 2012 tlne City Council reviewed the Conditional Use permit at 410rJTest 1" North - to allow an Assisted and Residentnl Care Facility - (N{adison -Cattiage
Cove).
City Attotney Stephan Zollingerdisclosed he has a conflict of interest with this proposal
because of his involvement with the Madison Memodal Hospital Board which is in
partnership with this assisted carc facihty.
Ptesentation by applicant: David Thueson at 360 \7est 3500 North owns the homestead
assisted livmg facility. This proposal is a 40,000 sq ft short stay facility. patients will stay
anywhere fiom 5 to 100 days. The main focus is physical therapy, occupational therapy, and
speech thetapy. The North wing has 20 rooms and the South wing has 15 rooms. Thi

My wife and I have owned the property at 472 west L't North since 2007. Although we do not currentlylive in Rexburg, two of our daughters have lived in this home. We have always taken pride in having ahome in Rexburg and when the time comes retire in this home. lt is a quiet residential neighborhood
and somewhat of an oasis from the busier neighborhoods closer to the university.
Not knowing the size of the proposed facility it is difficult for me to comment favorably on this permit.
However, I would not object to the issuing of this permit, if the size and appearance of the facility
maintains the open space and quiet felling of the neighborhood. I am especially concerned aboutincreased traffic along 1't North and adequate off-street parking for employees, residents and visitors ofthe facility.
I trust the commission will make a decision that will not adversely change the appearance and feeling ofthis homeowner residential neighborhood.

Be in accordance with a specific or general objective of the City's Comprehensive plan and theregulotions of the City of Rexburg Development Code.
Comprehensive Plan
The City's Comprehensive Plan has designated the subject property as both Low to Moderate andModerate to High Density Residential. The zoning nts ttre use. Therefore, this request is inaccordance with the Comprehensive plan.
Development Code (Ordinance 1026)
Both MDRI and MDR2 zones allow the use with a conditional use permit.
Be designed and constructed in a manner to be harmonious with the existing character of theneighborhood and the zone in which the property is located.
The building will have to meet the standards of the- Development Code. There is a assisted livingcenter across the street to the south of the proposed project. Also, there are apafiment buildingsdirectly to the northwest.
