BACKGROUND The applicant is requesting to change the Comprehensive Plan Map. The property currently has a commercial strip mall. The proposal is to provide apartment housing near job centers for a Mixed Use (MU) property. The property within a mile of the BYU-Idaho campus. II. SITE DESCRIPTION The parcels being changed are bordered between Pioneer Rd and S Yellowstone Hwy. The total area involved in this Comprehensive Plan Map change request is approximately 1.87 acres. The zoning of MU will allow the applicant to build a 3-story building with 14 units, limited by the parking required for the commercial businesses. III. ANALYSIS If approved the request will result in changing the zone from Community Business Center (CBC) to Medium Density Residential 1 (MDR1). The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. The applicant is seeking a Comprehensive Plan Map Change from Commercial to Neighborhood Commercial/Mixed Use. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. See Public Works review. (Yes.) c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. See Public Works review. (Yes.) d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. None. e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. School district property to the Southeast was recently rezoned Public Facilities. f. Meets the requirements of the Development Code. A Comprehensive Plan map change is being pursued to match the zoning request. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to change the above described property from Community Business Center (CBC) to Mixed Use (MU) if the Commission finds that the request is in the best interest of the neighborhood and the community.
