HomeMy WebLinkAboutLID 48 Item 11 - Kristy Coy 317 W 2nd NJanuary 9, 2020
Dear Kristy Coy,
I tried calling the phone numbers on your letter and phone number listed on your utility account. Both
phone numbers were invalid. Below is the City of Rexburg response to your concerns regarding LID 48:
Bullet 1: The east driveway is cracked. The work is under warrantee and will be fixed in the spring of
2020. The width of the driveway before reconstruction was 11’ 2” and that is what the current size is.
You may go to https://madison.rexburg.org/ to measure the size of the driveway before the work was
complete.
Bullet 2: The west driveway width before the reconstruction was 10’ 8”. After the driveway construction,
the width is was 10’ 2”. Road vehicles cannot exceed 8’ in width without a red flag or other safety items.
The current width is large enough for residential vehicles. The city recommends giving a credit for the
difference in driveway width (12 inches x (1 yard / 36 inches) x 5.83 yards x $48.70/yard) for $94.66.
Bullet 3: Edstroms, the City contractor, will install sod in the spring of 2020.
Bullet 4: City of Rexburg Ordinance 1019 Section A “All persons, firms, or corporations owning or
occupying premises within the corporate limits of City of Rexburg shall maintain safe and traversable
sidewalks adjacent to said premises consistent with the applicable standards set forth by the City of
Rexburg.” The adjacent property owner to sidewalk is liable for injuries that occur as a result of poorly
maintained sidewalk.
Bullet 5: The Notice of Intent to Create LID 48 hearing letter was mailed 12/26/18. The letter was not
returned. The City makes a copy of all LID notices mailed because of the sensitive nature of LIDs. In
addition to mailing notice, the hearing was published in the local newspaper twice before the hearing.
Sincerely,
Noah Phethean
