CONDITIONAL USE PERMIT FOR BONNIE RICE
On August 23, 2000, Bonnie Rice appeared before the Planning & Zoning Commission
for the City of Rexburg with a request for a conditional use permit at her home for an
apartment at 502 E. 1" North. The current zone is Light Density Residential (LDRI).
The request was approved and recommended to go to public hearing.
On September 1, 2000, Bonnie Rice presented to the Rexburg City Clerk an Application
for Conditional Use Permit for property located at 502 E. 1" North, which legal
description is as folllows:
Lot 20, Block 3, Earl Garner Addition, to the City of Rexburg.
The City Clerk published the Notice of Public Hearing in the local newspaper on
September 8, 2000 and September 15, 2000, posted a notice on the property and sent
notices to all property owners within 300 feet of the above mentioned property.
4. On September 27, 2000, Bonnie Rice appeared before the Planning & Zoning
Commission of the City of Rexburg at a public hearing with a request for a Conditional
Use Permit for an apartment in the basement of her home located at 502 E. I' North.
There was no public comment. It was recommended that this request for conditional use
permit be approved for public hearing before the City Council.
On October 4, 2000, Bonnie Rice appeared before City Council for the City of Rexburg
at a public hearing with a request for a Conditional Use Permit for an apartment in the
basement of her home located at 502 E. V North. There was no public comment. City
Council approved the Conditional Use Permit.

RE: PUBLIC HEARING FOR GLEN REED ZONE CHANGE

Stephen read the Notice of Public Hearing. John reviewed and described the location of the
property, between 4' and 5' South along the canal on the east side of the road and the proposed
tentative plans of Mr. Reed.
Davawn opened the public hearing.
Janice Allison - 405 W. 4`h South
She lives across the street from the mentioned property and questioned what the plans are for
this location. This area is highly residential and she does not feel the street can handle the
additional traffic, the road is dangerous, there is a hazardous comer and there are a lot of
accidents at that location.
No further comment and the public hearing was closed.
Discussion was on this property being left HBD, depending on the business that might go in it
could create more traffic than apartments would and the need to address the road and bridge as a
safety hazard.
Mike made a motion to approve the zone change from HBD to HDR and send on to public
hearing with the City Council. Doug seconded motion, all voted aye, none opposed.
RE: TODD HILL ZONE CHANGE AT 10 BARNEY DAIRY ROAD

John showed an aerial map showing the location of this property south of Barney Dairy Road
and east of 3rd East across the road from District 7 Health. This parcel is currently zoned
industrial and they are requesting a change to HBD.
Ray Walker owns the property and felt good about the change. He feels it can't be used for an
industrial use anyway and this proposal would be a good use of the property.
Nannette Hill, wife of Todd, presented a new drawing showing the proposed use of the land.
Roger made a motion to send this request to public hearing, Ted seconded the motion. All voted
aye, none opposed.
RE6 BONNIE RICE REQUEST C.U.P. REQUEST FOR APARTMENT

John related the history of the property in question located on the corner of Millhollow and I'
North. It has a 3 car garage, circular driveway, basement is a half basement with egress
windows and in the past was used as a separate living residence. The property is located in
LDRI and does require a conditional use permit.
Bonnie states that 2 cars will be in the garage and the driveway is large enough to allow 2 cars,
giving this parcel ample parking. The plan is to use the apartment for 4 students. A person can
crawl out of all the bedrooms windows, the Fire Department has been there to check all the
smoke alarms.
Doug made a motion for this request for a conditional use permit to go to public hearing with a
condition that it meet the building standards. Motion was seconded by Bobbette. All voted aye,
none opposed.

Marsha made a motion to approve the minutes. Motion was seconded by Paul. All voted aye,

Public Hearing for Bonnie Rice C.U.P.
The Mayor read the notice of public hearing for Bonnie Rice. He opened the public hearing,
there was no public comment, the hearing was closed. Val reviewed the circumstances of the
conditional use permit, there is ample parking for an apartment and it has complied with the
building code requirements.
Kay made a motion to approve the conditional use permit, seconded by Glen. All voted aye,
none opposed.
Jason Stucki brought before the Council his request that ticketing vehicles parked on the streets
not begin as it always has on the l' of November but be delayed until the first snowfall. He had
been informed that last year there were nearly 200 tickets issued for vehicles parked on the
streets after November 1, and he felt that was too many. He suggested more publicity or paid
permits. Chief Archibald explained that the ticketing date is posted, is advertised in the local
paper, the Ricks College Scroll, it is on the radio, notices are in each packet issued to the
college students and that before November 1 there are 3-4,000 warnings issued on vehicles.
There was also discussion that by the time the snow falls it is too late to get the vehicles off the
street because it is time to plow.
Kay made a motion to table this matter until such time that Jason can come up with more
information or reasons for delaying the ticketing date. Motion was seconded by Marsha. All
voted aye, none opposed.
Public Hearing for Todd Hill
The Mayor read the Notice of Public Hearing for a zone change at 10 Barney Dairy Road. Todd
explained the location of the property and the reasons for requesting the zone change. The
public hearing was open, there was no public comment, the hearing was closed.
Kay made a motion to approve the zone change as recommended by Planning & Zoning. Glen
seconded the motion, all voted aye, none opposed.
A map showing the recommended City/County addressing boundaries was distributed.
Discussion of the work being done, the need for this project, and the clearer boundaries for
easier access by emergency services departments. Glen made a motion to approve these
boundaries, seconded by Kay. All voted aye, none opposed.
Life Safety Recommendations which had been presented to the Council were discussed by Val.
The need for these recommendations was instigated by the number of older apartments
changing hands, the need for new business licenses, inspections for such licenses and the
number of life safety issue violations. Val had worked with a committee including the Fire
Department personnel, several apartment owners and a real estate agent to come up with these
recommendations.
There is some flexibility in this document in that if anyone disagrees with the requirements and
does not comply within the suggested time period, the matter can be taken before the U.B.C.
Board for appeal.
Glen made a motion to table this until legal counsel was available, Donna seconded the motion.
Discussion before a vote was taken came from some of the apartment owners. Ross Farmer, a
member of the committee and an apartment owner suggested that Val attend a meeting to review
these recommendations with all the householders, which is tentatively set for October 26, at 7:00
at Greenbrier Apartments.
Shawn Branson, manager for the Huntington and Danbury apartments expressed his appreciation
to the committee for the work being done. He and his owner support the life safety issues and
agrees with items 1 through 11 but feels that the next item giving the owners 3 months to comply
is not enough time and would request this be changed to 18 months to coincide with other
apartment complexes.
It was concluded that Val should meet with the householders, work out any other details which
concern the householders and this matter would appear on the Council Agenda again on the first
meeting in November for Council review.
Glen withdrew his motion to table, Donna withdrew her second.
Mayor gave an update on the North Highway project. Communication with Norm Thompson
concerning property he owns in the area and the possibility of making 5 lanes on the Salem
Highway to provide a turn lane at Cemetery Road is in progress.
The sewer project is progressing well and should be complete by the end of October.
Val reported that bids had been received on the sprinkler system at the Nature Park and soccer
fields. Kerry Morgan received the bid for the installation and Sprinkler World received the bid
for materials. They anticipate this project can begin within the week. The Skate Park is not
included in this bid, that will be done by the City next spring.
The Mayor reviewed the plans for the Open House for the new image of City Hall which will be
held Wednesday, October 18. He asked for the Council to be available to help with tours during
the time period. Marsha will be able to help from 11:00 to 2:00, Glen anytime, Kay anytime,
Paul after 6:00, and Donna anytime.
Donna reminded everyone of the facilitators which will be available all day Thursday, Oct. 5, to
review matters with the Recreation Committee for the Community Campus Complex. They will
be in and about the City all day, a meeting will be held at 7:00 p.m. in the Council Room.
Paul made a motion to pay the bills, Kay seconded the motion. All voted aye, none opposed.
Paul made a motion to go to Executive Session on a personnel issue, Kay seconded the motion,
all vote aye, none opposed.
Glen made a motion to reconvene, seconded by Paul, all voted aye, none opposed.

Ted made a motion to approve the minutes of the last meeting. Motion was seconded by Gary,

Davawn had John review the discussion and decision made by the City Council on the Parking
Ordinance.
Public Hearing - Bonnie Rice
John read the Notice of Public Hearing and gave an explanation as to the location of the zone
change request.
Davawn opened the public hearing.
Bonnie Rice commented that because of the building code issue in one of the bedrooms she
would be renting to a couple and not using that room as a bedroom but rather as a sitting room.
Other than that all the requirements had been met.
There was no other public comment, the public hearing was closed.
Bobbette made a motion to recommend approval of this request to go to public hearing before
the City Council. Raymond seconded the motion, all voted aye, none opposed.
