Summerfield Subdivision Ph 8 City of Rexburg Development Code (Ordinance No.1200) § Amendments to this Ordinance § 1.03.080 (D) "The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied" The subject property is part of a Planned Unit Development and as such must comply with the Summerfield Subdivision Masterplan. ANALYSIS The Rexburg Development Code allows for the Commission to make recommendations to the City Council regarding whether or not the plat meets the requirements of Development Code Section 1.01.030. Below, Staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by Staff’s analysis of each criterion. Criteria Subdivision Plat Requests: 1. Harmonious development of the area. The lot sizes are consistent with those from previous divisions. Coordination of streets and roads within the subdivision with other existing or planned streets and roads. The roads were identified on the Master Plan. 3. Adequate open space for travel, light, air and recreation. As part of a PUD the open space and recreation amenities were outlined with the Master Plan. This division is keeping in harmony with the PUD. 4. Conservation of or provisions for adequate transportation, water drainage and sanitary facilities. Irrigation plans were not shown on the landscaping plans. Case No. 19 00541 Page 1 5. Avoidance of population congestion as would involve danger or injury to health, safety, or general welfare by reason of: a. Lack of water supply, drainage, transportation, or other public services; or Irrigation Certificate needs to show the instrument number. b. Unnecessary imposition of an excessive expenditure of public funds for the supply of such services. The City Engineer has approved the transportation and utilities of the division. 6. Requirements as to the extent and manner in which: a. Roads shall be created and improved; and water and sewer and other utility mains; piping connections, or other facilities shall be installed as conditions precedent to the approval of a plat. The City Engineer has approved the transportation and utilities of the division. 7. Manner and form of making and filing of any plat. a. Administration of these regulations by defining the powers and duties of approval authorities; including procedures for the equitable review and approval of all plats or subdivisions covered by these provisions. State statutes and City Development Code requirements have been considered with the staff approval. Owner of record is K Holdings LLC, not BV Summerfield LLC. The ownership needs to be corrected before this plat is recorded. III. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the Summerfield Subdivision Division No. 7 with the following conditions: a. Approval by the County Surveyor is required. b. The ownership shall be corrected prior to signatures on the plat. c. Instrument number for the Irrigation Certificate will need to be shown on the plat. d. Irrigation plans shall be shown on the Landscaping Plan. Case No. 17 00219 Page 2
