Waiver and Release of Liability
While constructing a building on their property, it came to the attention of Jay and Sandra Fluckiger,
here -in -after party of the first part, that the building was not in compliance with City of Rexburg zoning
requirement, to wit: buildings are to be constructed six feet from the property line.
To compensate for this oversight, the City of Rexburg has agreed that if the adjoining neighbors, Daniel
and Lindsey Dewey, here -in -after party of the second part, together with their heirs, executors,
administrators, assigns or personal representatives are willing to allow the parry for the first part,
together with their heirs, executors, administrators, assigns or personal representatives, access on the
Dewey property to the extent of 4 % feet inside the property line as necessary to repair, paint or
otherwise maintain the building, the party of the first part will disturb or rearrange the neighbor's
personal property inside this 4'/: foot line only to the extent necessary to perform such maintenance.
Both parties agree to indemnify and hold harmless the other against any and all claims, suits or actions
of any kind whatsoever for liability, damages, compensation or otherwise brought by anyone, including
attorney's fees and related costs, if litigation arises pursuant to
connection with this agreement.
