HomeMy WebLinkAboutCity Council 08212019 City Council Work Meeting E-Scooters Mobile Food Vendors August 21, 2019 1 What Other Cities Are Doing Regulating: The number of e-scooters Permitting: Registering each e-scooter individually, with an associated fee Parking: Restricting where e-scooters are able to be parked Maintenance: Setting standards for safety and maintenance Who can ride: Only adults (18 and older) Responsiveness: Requiring a person to be on call 24-hour a day Speed: Limiting overall speed, limiting speed in certain areas Service Area: Limiting e-scooters to a specific geographical area 2 E-Scooter Stand-up electric scooters are to be ridden on streets, and where available, in bike lanes and bike paths. Stand-up electric scooters are to stay to the right of street lanes and to offer the right of way to bicycles in bike lanes and on bike paths. Users of Stand-up electric scooters shall be 18 or older. Users of Stand-up electric scooters who violate these provisions may be fined by City consistent with fines for cyclists. 3 E-Scooter Pilot Agreement Six month term, renewable every six month thereafter E-scooters will be governed by the same standards as apply to cyclists Speed limited to 8-mph in Downtown and in parks Fleet size limited to 250 scooters per company E-Scooter daily start locations must be approved by City 4 Parking 5 Private Property Stand-up electric scooters shall be prohibited from operating and shall restrict use on private property; as well as the Brigham Young University-Idaho Campus and properties, unless: A Stand-up electric scooter company which has received permission from private property owners must notify the City of their right to operate on said private property by filing a signed agreement between the Company and the private property owner. Failure to notify the City will result in actions defined in Section 6. Areas generally open to the public, parking lots etc., are allowed unless otherwise noted by the property owner. 6 Other Rules, Registration & Fines The Company shall register their business with the City Clerk and pay for a City Business Registration and pay $1.25 for each e-scooter that operates in Rexburg annually. Company shall provide education to Stand-up electric scooter riders on company rules and regulations, safe and courteous riding, proper parking, as well as the City’s rules and regulations. Stand-up electric scooter riders are required to take a photo whenever they park their scooter at the end of a ride.  Company shall maintain 24-hour customer service Stand-up electric scooters continuously parked in one location for more than 48 hours may be impounded at a cost of $20/scooter 7 Mobile Food Vendors Amendments to Ordinance 1029 8 These recommendations are for amending Ordinance 1029, and apply ONLY TO MOBILE VENDORS. The intent is to make these vendors truly mobile and restrict them to city streets and rights-of-way. 9 Major Amendments Mobile Vendors are to be truly mobile Hours of Operation: 7:00 am to 11:00 pm Sunday through Saturday Restricted to streets immediately adjoining commercial and mixed use zones Arterials, such as 2nd E, Main Street, etc. are prohibited Removal of Seasonal Vendor definition Definition of Temporary now means less than 24-Hours No registration required for vendors 14 or fewer days in a calendar year 10 Mobile Vending Approved Area Map Mobile vendors may locate only on designated streets, as shown on map. Mobile on-street vendors must use appropriate parking stalls, and observe any time restrictions 11 Changes & Updates to Definitions 12 Bond Requirements Legal suggests removing bonding requirements and recommends requiring proof of Liability Insurance to be set $500,000/$1,000,000 13 Hours of Operation 14 Update to Section 6.01.260 Identified Vending Locations are now shown on Map: 15 Registration & Fees Annual Mobile Vendor Fee: $500 per year 16 Proposed Food Court Overlay Proposed Ordinance 10XX 17 Land Use Standards This proposed ordinance applies only to vending locations on private property. This is intended to apply to the property owner. 18 Approved Zones Applies only to commercial districts and mixed use zones (with a commercial component) 19 Definitions 20 Definitions 21 Change of Use : Land Owner Request for Food Court Overlay 22 Site Requirements 23 Food Court Surface 24 Building Permits Required 25 Food Court Vendor Densities Food Court locations shall be a maximum of 15  sites per acre. 26 Parking All parking lots shall be paved in accordance with Development Code Section 3.4 Whether attached to individual vendor location or otherwise, each vending location shall provide adequate space for the parking of at least four (4) motor vehicle per vending location  in addition to the site provided for the vending unit, which occupies each such site. Each such parking space shall be at least 20 feet in length by 9 feet in width and shall not block access by emergency vehicles. 27 Utilities Utility service connections are permitted. Property owner shall provide water and sewage systems, sanitary stations, and convenience facilities in accordance with the regulations of the State of Idaho Plumbing Code, Idaho Department of Health, and the State of Idaho Department of Environmental Quality. 28 Restrooms There shall be a minimum of 1 (one) toilet or lavatory for every five vendors, with a minimum of 1 per overlay. These facilities shall be meet the regulations set forth by the State Plumbing Code and the State of Idaho Department of Environmental Quality. 29 Proposed Property Owner Fees 30 Application of New Standards Staff recommends that existing contracts be allowed to finish there terms All properties must be in compliance with new regulation no later than 3 years from final adoption 31
