MUIR Fee: 0.00 Ex -Officio Recorder Deputy x' F{i cQ CITY OF x REXBURG n America's Family Community ORDINANCE NO. 1213 Annexing N Hill Rd Enclave and Approximately 829 South 5' West AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been requested to annex the same to the City of Rexburg, Idaho, and WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described property is subject to annexation to the City of Rexburg under and pursuant to the provisions of Section 50-222 - Category A, Idaho Code, and that said lands should be annexed to and become a part of the City of Rexburg, Idaho, and WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and Zoning Commission, and the Planning and Zoning Commission made its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed, and WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the property to be annexed is as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS: The property for Location 1: from approximately 120 N Hill Rd to 790 Barney Dairy Rd in the Rural Residential 1 (RR1) zone; and, Location 2: at approximately 829 South 5"' West in Rural Residential 1 (RR1) zone; in the Impact Area for the City of Rexburg. These properties (#19-00169) are hereby annexed to the City of Rexburg and are hereby declared to be a part of the City of Rexburg, Idaho. The zoning for both properties will remain as Rural Residential 1 (RR1) zone. The property is described as follows on the updated Annexation Map: Legal Description: Location 1: North Hill Rd Commencing at the East quarter corner of Section 20, Township 06 North, Range 40 East, Boise Meridian, and running thence West along the center section line 1220.00 feet more or less to the intersection of the current Rexburg City Limit Line; thence South 678.00 feet more or less along the East boundary line of the Ricks -Palmer Subdivision, Division 4 and the current said City Limit Line to the Southeast corner of Lot 14, Block 6 of said subdivision; thence S82°30'15"E 67.70 feet to the east boundary line of said subdivision; thence SO°30'31"E 93.68 feet; thence S3°36'23"W 102.84; thence S7°54'53"W 105.90 feet being the Southeast comer of said subdivision; thence West 38.50 feet more or less to City Limit Line and parcels known as Mill Hollow Trailer Park; thence in a Southerly direction along said property and current City Limit Line 798.00 feet more or less to where the city limit line changes direction; thence East along City Limit Line 168.00 feet more or less; thence continuing along the City Limit Line North 9.00 feet more or less; thence East 155.00 feet more or less along City Limit Line to the Southeast corner of parcel known as RP06N4OE209140; Thence in a Northerly direction 1849.00 feet more or less along the East boundary line of the following parcels RP06N4OE209140, RP06N4OE209044, RP06N4OE207747, RP06N4OE207796, RP06N40E207627, RP06N40E207534, RP06N4OE207454, RP06N4OE207378, RP06N4OE207214, RP06N40E207242 to where it ORDINANCE NO. 1213 -b intersects with the Barney Dairy Road right of Way; thence East along City Limit Line and Barney Dairy Road right of way 632.00 feet more or less to the East section line of said section; thence North along said section 31.00 feet more or less to the point of beginning. Location 2: 829 South 5`s West (Steiner Property) Commencing at a point 936.00 feet South of the Northwest corner of Section 31, Township 6 North, Range 40, East, Boise Meridian, and running thence East 658.11 feet to the East bank of the Rexburg Irrigation Canal; thence S06028'50"W 118.65 feet along the East bank of the Canal; thence S57°01'39 W 242.82 feet, more or less, along the East bank of the Canal, to a point 1192 feet South and 434.00 feet East of the Northwest comer of Section 31; thence West 434.00 feet; and thence North 256.00 feet to the point of beginning. SECTION I: That the above described property hereby annexed to the City of Rexburg be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg as above set forth; that the Zoning shall be amended to show this annexation and classification of the above described property so annexed and that said amendment shall be certified to and declared to be the official Zoning Map of the City of Rexburg by a certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
