HomeMy WebLinkAboutWRITTEN RESPONSE 1 - 19-00276 - 669 S 12th W - CUP for Accessory ApartmentBased on the information given in the Notice of Public Hearing dated 26th day of May 2019, a request has been made to place an accessory apartment at the residence located at 669 S 12th W in Rexburg, Idaho. As per the City of Rexburg in Madison County, the ordinance 4.01.070 states that one single family dwelling may be placed on a lot or parcel of land in the RR1 Zone. Our concern is that if a conditional use permit is granted that impacts the integrity of this ordinance, it will also lead to other properties being allowed to add a second family dwelling and could lower the property values in this area. Background: The residents of the Willow Brook Estates, including Willow Brook Circle, Blue Willow Circle, and the residents on 12th W who are proximal to the proposed property purchased their homes and property because there is an acre of ground for each residence. We take pride in beautifying our yards and properties, and have actually adhered to Declaration of Covenants, executed on May 29, 1997, because we believe in maintaining the character for our neighborhood. The Covenants clearly state that our lots "shall not be sub -divided or in any way reduced in size," and that "no building should be erected, altered, placed, nor permitted to remain on any such lot other than one detached single family residential dwelling and private garage." Our homes have been built, purchased, and maintained with respect for these covenants; as a point in fact, as neighbors we have relied on these protective covenants to maintain the vision for our neighborhood. Additional, but legitimate concerns: First, let it be stated that we thoroughly oppose the placement of the "tiny house" on the property on 12th W before this apartment has been approved in a meeting with the Planning and Zoning Commission and us, the citizens of the affected area. Also of importance, we are highly concerned about the effects of the additional demands on the ground area for sewage and for our wells, which at this point are operating as they should. If additional residences, regardless of size, are added to the one -acre lots, the climate and integrity of the neighborhood is subject to veer completely away from the original intent, which intent underlies our purpose for buying or building a home in this particular neighborhood. Because of the schools, 12th W is already a very busy road throughout the day. Because of the Meadows apartments, 7th S is a very busy road, day and night. There are a number of small children in our area, and with the increase of residences, small or large, there will be additional traffic. We are concerned for the safety of our children and grandchildren with the additional movement of vehicles.
