Absent: Bruce Sutherland, John Bowen, Kristi Anderson. Minutes: From Planning and Zoning meeting – May 16th, 2019 MOTION: Motion to accept the minutes as recorded, Action: Approve, Moved by Steve Oakey, Seconded by Vince Haley. VOTE: Motion carried by unanimous roll call vote (summary: Yes = 8). Yes: David Pulsipher, Greg Blacker, Keith Esplin, Melanie Davenport, Rory Kunz, Steve Oakey, Todd Marx, Vince Haley. Chairman Rory Kunz talked about the first meeting in July is the 4th of July. What do we want to do? MOTION: Motion to cancel the meeting for July 4th. The Commission will resume on July 18th, Action: Cancel, Moved by Steve Oakey, Seconded by Keith Esplin. VOTE: Motion carried by unanimous roll call vote (summary: Yes = 8). Chairman Rory Kunz asked Steve Oakey if he is prepared to discuss the zoning lists. Steve Oakey listened to a podcast today given by a city designer who has written a book. The gentleman mentioned the zoning lists become gospel for certain zones; they have the effect of guiding people. The problem with Madison County and the Edstrom gravel pit was referenced. Steve is still in favor of getting rid of the lists and going toward more general descriptions. He believes there is a collective intelligence to decide for ourselves; a common understanding. Public Hearings: 1. 6:35PM Rezone (19-00278) – to rezone various Urban Renewal and City of Rexburg owned properties from various zones to Mixed Use (MU) or Public Facilities (PF). (action) – Stephen Zollinger 35 North 1st East Rexburg, ID 83440 Phone: 208.359.3020 Fax: 208.359.3022 www.rexburg.org Planning & Zoning Minutes June 6, 2019 2 Staff Report: Stephen Zollinger stated there a number of parcels being presented owned by Urban Renewal or the City. The first is the parcel in the Trejo area. This is a piece of property that was developed with the Westates Subdivision. When it was originally developed, the parcel was maintained by the owner. The area has been used as a retention pond. The city sought and received a contribution of this property for the purpose of converting this area into a park. Vince Haley asked if this will be a developed park? The city will maintain this area as part of the park system. It is unknown what kind of park this will be. Right now, the city is identifying the use of each park to identify and categorize who the park will serve and uses for those parks. There will be no soft features due to the area needing to remain used as a retention pond. The pond fills up and then drains into the Main Street service line. This area only fills up when there are really, really heavy storms. The city has been maintaining the property, but the city hasn’t owned it. The changed ownership of this property will allow the city to develop the land as needed for park use. 829 S 5th W, Steiner property is also a parcel donated to the City of Rexburg as a park use property. The city had reached an agreement with Mr. Steiner for the donation of this land as a park. Mr. Steiner passed before the deal was completed. Mrs. Steiner has honored her husband’s agreements and completed the transfer of the land to the city. Over the next several years, this land will be converted to a park. It has been proposed this property may be combined with some property to the east, owned by the University. The University has used this land as their test crop area. The University is seeking to move their ropes course and activity courses that used to be at Badger Creek to this adjacent location, because Badger Creek has recently been sold. If the University will allow it, and their proposed change is approved, the city will probably put grass and casual activities on this Steiner property with a bridge to tie the activities portion of the BYU-Idaho park and the Steiner properties together. The Barney Dairy property is another parcel purchased recently by the city; this is another park property. The area that is the head of the duck, will be developed like Smith Park to serve the community around this park. The quad to the south will be built next year with softball and baseball areas. Trees and jogging areas are possible for this park. This will be the third 10+ acre park in the city and will act as more of a destination park. David Pulsipher asked if this would be part of the 3 present jogging path along the river. The East Parkway Corridor was shown. Short-term the city is looking at funding a tie in to 7th S. with the East Parkway Corridor. A temporary access will tie into 7th N. until Madison County and Sugar City take the necessary steps to tie the Corridor the rest of the way into Sugar City. The city is working to purchase the right- of-way to the east of this parcel along 7th N. The city will create a parking lot for the parks and a bridge access to the park from the Stonebridge subdivision area. The short-term proposal to access the park right now will be from Barney Dairy Rd. over the old landfill. The walking path terminates right now at the Barney Dairy property. The walking path would continue up this access to the park. The walking path will also be extended along the Junior High property this year. The bottom two parcels on the agenda are a pump station on 12th W and one at approximately 1197 S. Yellowstone Highway. These two parcels are simply being zoned as to their current use for purposes of maintaining the same zoning on all public facilities. The last parcels are on the corner next to Broulims owned by Urban Renewal. This item has been moved to the end of the presentation due to the request of an interested party. Centennial Granary is to the North. These parcels were purchased by Urban Renewal as blighted and underutilized properties. There is a potential purchaser, however, no definitive plans have been presented at this point. The request for Mixed Use is suggested to allow a larger availability of options for this property. Interested parties have requested at least some housing components in conjunction with commercial components. There has not been a lot of desire for a cooperative use of the back side of the Broulims building. Chairman Rory Kunz asked the Commissioners if they had any clarification questions for staff. Melanie Davenport asked, were some of these parcels identified as part of the Parks and Trails study? Stephen Zollinger responded, the Parks and Trails study is continuing. The plan allowed the city to identify where parks were needed and the sizes that would be desired. The city was then able to look at available property for purchase to follow this plan. Chairman Rory Kunz asked the Commissioners if they had any conflicts of interest or had been approached by any parties relative to this particular subject. If you believe your prior 4 contact with respect to this subject has created a bias, you should recuse yourself, otherwise at this time please indicate the nature of your conversation or contact. Chairman Rory Kunz reviewed the public hearing procedures. He closed the public input portion of the hearing at 6:53p.m. Melanie Davenport thinks it is worth noting that the city has been proactive in acquiring properties for parks and connecting the trail system. She likes to see the city using the study that was approved, as well as their own knowledge of the community to improve the park and recreation system of the city. Steve Oakey disclosed he owns a property directly south of the Urban Renewal properties. The Commission appreciates Steve noting his ownership, but they do not see any reason why he would need to recuse himself from voting as he does not own any of the properties being voted on. MOTION: Move to recommend to City Council the approval of the zone changes as referenced because the request fits the purposes of the property and their intended uses., Action: Approve, Moved by Keith Esplin, Seconded by Todd Marx. Updates from City Council City Council heard the annexation proposal for the N. Hill property and Steiner Park property yesterday evening. The City Council also recommended the zoning stay as Rural Residential 1 for the N. Hill property. Heads Up: Hearings: June 20th (19-00276) 669 S 12th W - Conditional Use Permit for an Accessory Apartment in RR1 City Council keeping their schedule. What does the Commission want to do?
