NOTICE OF PUBLIC HEARING
TO AMEND THE DEVELOPMENT CODE
FOR THE CITY OF REXBURG
Public Hearing: April 18, 2019 at 6:40 pm to be held before the Rexburg Planning and Zoning
Commission (#19 00093) to amend the current DEVELOPMENT CODE (Ordinance 1200) for
the City of Rexburg.
It is proposed to amend the current DEVELOPMENT CODE concerning substantive and
non-substantive items. All proposed modifications to the DEVELOPMENT CODE may be
reviewed at the offices of Planning and Zoning or the City Clerk’s office. The proposed
substantive changes amending Development Code Ordinance No.1200 (by section) are
delineated below:
PROPOSED CHANGES TO THE DEVELOPMENT CODE
CHAPTER 9.03 PUBLIC FACILITIES
9.03.020 Permitted Uses – Added Fairgrounds, Golf Course, Sports Fields, and Swimming
Pools to Outdoor Recreation; added Theatres to Indoor Recreation.
9.03.030 Lot Area – No minimum lot size.
9.03.040 Lot Width – No minimum lot width.
9.03.050 Lot Frontage – No minimum lot frontage.
9.03.100.a.1 Building Height – Amend to “The horizontal setback of the building from the
nearest residential zone boundary is equal to or exceeds twice the building’s height;”
9.03.150.f Other Requirements – Added “Public facilities, public schools and parks which
are currently in existence by legal process, may modify for continued use, provided any
changes are submitted to the City for administrative review and approval.”
At such hearing the Planning and Zoning Commission will hear all persons and all objections and
recommendations relative to such proposed permits. The City Clerk will also accept written
comments at City Hall prior to 4:00 p.m. on April 17, 2019. This notice is given pursuant to the
provisions of Section 67-6508, 67-6509 and 67-6511 Idaho Code, and all amendments thereof.
