From High Density Residential 1 (HDR1) to High Density Residential 2 (HDR2)
1. December 17, 2018, A request for rezone from High Density Residential 1 (HDR1) to High
Density Residential 2 (HDR2) from Mike Wade.
2. January 7, 2019, Notice was sent to the paper to rezone the property for the Planning &
Zoning meeting on February 7, 2019, to be published January 22nd and February 1", 2019. A
Staff Review Summary was sent to Mike Wade and Richie Webb. Tawnya also talked to
Mike Wade on the phone discussing the meeting schedule and she sent a link to the
Development Code to him.
3. January 17, 2019, a notice with public hearing procedures was sent out to all neighboring
parcel owners by mail.
4. January 28, 2019, a completed Staff Report and Staff Review Summary were sent to Mike
Wade regarding any changes or staff recommendations for the rezone.
5. January 30, 2019, the notice was posted on the property.
6. February 5, 2019, an agenda was send to Mike Wade asking him to present his application.
7. February 7, 2019, a hearing is held before the Planning & Zoning Commission.

High Density Residential 1 (HDR2). There
is no HDR2 zoning adjacent to or in this
area of the city, however, the parcel is
ad'acent to some Mixed Use parcels.
Presenter: Attorney Zollinger
The project was originally constructed by
Bron Leishman. The property is across the
street from Tri-State Tire. On the North is
the Twin Pines apartments. At the time it was originally constructed, a series of building
were built on the east side of the development for storage. The applicant has seen little
desire for the tenants to make use of them. The applicant is asking to rezone to HDR2 to
allow the conversion of storage areas into apartments.
Chairman Davenport asked if the commissioners have a conflict of interest. None.
Compliance Officer Powell presented the staff report. There are no public works issues or
extra traffic due to this change. Commissioner Steve Oakey stated this change does not
affect the height of the buildings and asked about parking issues. Powell answered the
applicant will need to turn in a site plan with the construction drawings indicating there are
enough parking stalls for the added units.

6:36p.m.

Commissioner Oakey asked if this change would require three readings in City Council. The
response was it would unless City Council waves the rules. This would need to be part of the
motion.
Chairman Davenport closed the public input portion of the hearing at 6:37p.m.
Commissioner Kristi Anderson asked if this change would be a "spot zone." A spot zone means
you are creating an island that is inconsistent with surrounding zoning. The adjacent zones have
similar densities, so this would not be considered a spot zone. Staff did not consider this to be
inappropriate for this area.
IR MOTION: Motion to recommend to City Council to approve the applicant's proposal
and suggest they consider this proposal third read, because this causes little change to
increase the value of the person's property., Action: Motion, Moved by Steve Oakey,
Seconded by Greg Blacker.

City Council Meeting — February 20, 2019
A. Ordinance 1206 #18-00712 —Rezone 146 North 1" West from High Density Residential 1
(HDR1) to High Density Residential 2 (HDR2)- Consider Suspension of the Rules - Stephen
Zollinger
City Attorney Zollinger reviewed the rezone at 146 North 1" West a map of the locations was
viewed on the overhead screen.
Council President Smith asked if there would be adequate parking available if the rezone is
approved to the higher density. City Attorney Zollinger explained the applicant would still need to
apply for the necessary permits to create the addition units. Currently, there are storage units on that
section of the property, They are review the option of converting the storage units into residential
units. Mayor Merrill said the development will need to have adequate parking when they are changed
to residential units.
Council Member Mann asked for a reason why the rules need to be suspended. City Attorney
Zollinger replied the applicate has submitted the application to begin the process of redesigning the
storage units. The city's building department has the application and is waiting for the rezone
approval to start the review process.
Council Member Flora moved to suspend the rules for Ordinance No. 1206 to approve the
Rezone at approximately 146 North 1" West from High Density Residential 1 (HDR1) to High
Density Residential 2 (HDR2); Council Member Wolfe seconded the motion; Mayor Merrill asked
for a roll call vote:

Council Member Busby moved to third read and approve Ordinance No. 1206 the Rezone at
