MUIR Fee: 0.00 ORDINANCE NO. 1200 Ex -Officio Recorder Deputy DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO AN ORDINANCE REPLACING AND REPEALING ORDINANCE 1115 AS THE DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO, AN ALL INCLUSIVE DOCUMENT INCORPORATING ITS AMENDING ORDINANCES AS FOLLOWS; ORDINANCE 1132 REDUCING PARKING IN MULTI -FAMILY UNITS; ORDINANCE 1154 CLARIFYING DEFINITIONS AND SETBACK AND RIGHT OF WAY EXCEPTIONS IN THE PED OVERLAY; ORDINANCE 1157 ADD DEVELOPMENT REVIEW COMMITTEE, CONSOLIDATE MIXED USE (MU) ZONES AND AMEND DENSITIES, CONDITIONAL USES AND COMMERCIAL LIGHTING STANDARDS; ORDINANCE 1159 ALLOWING REDUCED VISITOR PARKING IN PEDESTRIAN EMPHASIS DISTRICT (PED); ORDINANCE 1177 ALLOWING ALL ZONES TO HAVE ACCESS TO SHORT-TERM RENTALS; ORDINANCE 1181 REQUIREMENTS FOR FENCING AND SCREENING ALONG HIGHWAY 20 CORRIDOR ALSO PURPOSE AND USE OF MIXED USE ZONE; ORDINANCE 1188 COMBINING GENERAL BUSINESS DISTRICT (GBD) AND CENTRAL BUSINESS DISTRICT (CBD) INTO CENTRAL BUSINESS DISTRICT (CBD); AND ORDINANCE 1196 AMENDING HIGH DENSITY RESIDENTIAL 2 (HDR2) DENSITY AND SETBACK AND INCLUDE PARKER ADDITION BLOCK 4 INTO THE PEDESTRIAN EMPHASIS DISTRICT (PED); AN ORDINANCE MAINTAINING A DEVELOPMENT CODE FOR THE CITY OF REXBURG, DIVIDING THE CITY INTO DISTRICTS IN ACCORDANCE WITH THE COMPREHENSIVE PLAN; REGULATING AND RESTRICTING THE HEIGHT, NUMBER OF STORIES, SIZE OF BUILDINGS AND OTHER STRUCTURES AND OBJECTS, MAINTAINING DESIGN STANDARDS IN THE DISTRICTS, REGULATING THE PERCENTAGE OF LOT THAT MAY BE OCCUPIED BY STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, THE DENSITY OF POPULATION, LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE, COMMERCE, INDUSTRY, RESIDENCE AND OTHER PURPOSES; PROVIDING FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE; PROVIDING FOR ENFORCEMENT OF THE ORDINANCE; PROVIDING FOR EFFECTIVE DATE OF ORDINANCE. BE IT ORDAINED BY the Mayor and Council of the City of Rexburg, Idaho: SECTION I: Ordinances Numbered 1115, 1132, 1154, 1157, 1159, 1177, 1181, 1188, and Ordinance 1196 of the City of Rexburg, Idaho, are hereby repealed. SECTION II: The Development Code of the City of Rexburg, Idaho, is hereby amended by the following SIGNIFICANT CHANGES IN SUMMARY with detailed changes highlighted in Appendix A. SIGNIFICANT CHANGES TO THE DEVELOPMENT CODE IN SUMMARY Section # Explanation of Change Table of Reorganization of chapters and sections to improve readability and ease Contents of use. Entire Standardized, proofread and refined grammar Document 1.02.010 Clarified duties and responsibilities of Zoning Administrator, 1.02.020 Economic Development Team, and Strategic Development Team as 1.02.030 they pertain to development in the City of Rexburg Chapter 2 Amend definitions for daycare centers, nursery schools, duplex, and twin homes; Add illustrations to setbacks, lots, and sign definitions 3.02.180 Ordinance 1129 Special Flood Hazard Development added 3.02.190 Ordinance 1109 Fire Standards added 1 Section 4 Changes to Planned Unit Development UD Appendix B Engineering Standards added Appendix C Hemming Project Redevelopment Option(PRO) added General Consolidated parking and fencing standards, clarified sign calculations, Standards repeated standards for zoning es placed in front of those zones. Zoning Addition of parking structure incentive to Mixed Use (MU) Tables consolidation of commercial design standards. Impact Area Working to align with Madison County's impact area to facilitate transition. Removal of A-1, A-2, & RR1 from impact area (already referred to all zones for application); Sexually -Oriented Business (SOB) moved to su I mentary overlay. SECTION III: Providing for other substantive and non -substantive changes in the Development Code as recommended and approved by the Planning and Zoning Commission of the City of Rexburg, Idaho: SECTION IV: Repeal. All other ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. SECTION V: The City of Rexburg, Idaho City Council shall enact this Ordinance No. 1200 repealing Ordinance 1115 otherwise known as THE DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO upon its passage, approval and publication. SECTION VI: Appendix A. I, Stephen Zollinger, City Attorney for the City of Rexburg, declare that in my capacity as City Attorney of the City of Rexburg, pursuant to Idaho Code Section 50-901A (3) of the Idaho Code as amended, I hereby certify that I have reviewed a copy of the above cited Summary Section of Ordinance 1200 and have found the same to be true and complete and to provide adequate notice to the public of the contents, including the exhibits, of Ordinance No. 1200.
