HomeMy WebLinkAboutLID 4801-0010 322 W 2nd N - CooleyTo City of Rexburg concerning LID 48. 1 have talked with Noah Phethean concerning LID 48 and would like to go over the estimated replacements for the curb and gutter and "sidewalk" attached to curb and gutter for our property at 322 W 2nd N. I do not remember there being problems with these items. There was some work done on our curb and gutter by an unknown party in the summer of 2017 while we were not around and it looks like some of the suggested replacements are where these replacements were done. These can easily be seen on google maps which happened to take their pictures at that time. They also show up on your maps as holes in the curb and gutter as well as our space between the sidewalk and curb and gutter. I cannot look at the curb and gutter at this time because of snow cover but want to look at it with an engineer and see why the engineers think it needs to be replaced when the snow is gone. The letter for this that was sent to us was very unclear about what was going on and why we were being assessed this money. I hope to get a better understanding of this but feel it was made to look like this was our only time to object to it. Sincerely Bill Cooley 1/15/19 Tuesday January 15, 2019 (filed before 4:00 p.m.) To the City of Rexburg, Council Members, Planning and Zoning and to whom it may concern: We strongly oppose the projects proposed and the fees assessed notified to us via a letter for the city to make " improvements" on the property located at 322 West 2"' North in Rexburg. The letter that was sent to us, the owners of the aforementioned property was extremely vague. It assessed us over $5000 in improvements that the city wants to make and us to pay for. The letter did not include details of what those improvements would be but rather blanket generalizations. We are the only property on the block of our side of the street that has a sidewalk and curb and gutter. I do not intend to replace it or pay for someone else's sidewalk and curb and gutter. Additionally, since purchasing the property seven years ago, there have been at least 3 different times the city has dug up the waterlines for reasons unknown to us. Each time they have dug up our lawn and have replaced it with a few chunks of dried up sod that has not grown. The ground was left uneven and with gaps and not enough fill dirt. We have had to replace our sprinkler system twice between the side walk and street curb and lawn up to the water meter to try to get it back to the condition before the city dug it up. I am quite disturbed at the assumption that the city can notify an owner of property to pay additional fees for improvements that the owner did not request. In fact, I believe it is illegal. In addition to paying property taxes which should already fund these types of improvements, there are bonds or levys which are proposed and put to the vote of the people for water, sewer improvements, etc. There has been no such notice of a bond, levy or vote. (Idaho State Code Title 63 Revenue and Taxation) I would request this letter to be read and time for our vocal input placed on the agenda for Wednesday, January 16' to oppose whatever usurpations the city has in mind with my money.
