A perpetual easement and right of way in through over and across that certain parcel of land
situated in said Madison County, State of Idaho, bounded and described as follows:
Beginning at a point on the Easterly line of Railroad Right of Way 80 feet North and 150.75
feet, more or less, West from the Southeast corner of said Lot 4, and running thence West 17
feet, more or less, to the Westerly line of said Railroad Right of way; thence Northeasterly
134.8 feet along said Westerly line of Railroad Right of Way to a point 213.5 feet North and
149 feet, more or less, West from the Southeast corner of said Lot 4; thence East 17 feet,
more or less, to the Easterly line of said Railroad Right of Way; thence Southeasterly 134.8
feet along the Easterly line of said Railroad Right of Way to the point of beginning.
The aforesaid easement and right of way is granted for the passage of trucks, teams and
automobiles, the unloading and loading of railroad cars, and the installation, construction,
maintenance and use of pipe lines and unloading devices in connection with the business of
Grantee, its successors and assigns conducted on the parcel of land first hereinabove
described, and shall forever by appurtenant to the property first hereinabove described.
Tract 1: Commencing at a point I rod South of the Northeast corner of Lot 4 in Block 25 of
the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and running
thence South 100 feet; thence West 8 rods-, thence North 100 feet; thence East 8 rods to the
point of beginning, together with all of the rights contained in that certain Warranty Deed
dated November 30, 1923, by and between E.A. and Grave W. Beesley, his wife, and the
Texas Company, (now Texaco Inc.) which was recorded January 8, 1924 in Book 92 of
Deeds, page 565 records of Madison County, Idaho.
Tract 2: Commencing at a point 175 feet West of the Southeast corner of Lot 4 in Block 25
of the 04, of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and
running thence in a Northerly direction bearing Eastward a distance of 81 feet to a point
which is 80 feet North and 164 feet West of the point of beginning; thence East
approximately 13.5 feet; thence Northerly bearing Eastward 1.34.8 feet to a point which is
approximately 21.3.5 feet North and 1.32 feet, more or less, West of the point of beginning;
thence North 116.5 feet to the North line of said Lot 4, Block 25 aforesaid; thence West 73
feet; thence South 330 feet; thence East 30 feet to the point of beginning.
Commencing at the Southeast corner of Lot 1, Block 25, of the Original
Rexburg, Townsite, in the City of Rexburg, as per the recorded plat thereof,
and running thence South 161 feet; thence Went 112 feet; thence North 66 feet;
thence East 172 feet; thence South 49.5 feet to the point of beginning.
A tract of land situate in Lot 1, Block 25 of the
Original Rexburg Townsite, described as follows:
Beginning at the northwest corner of Lot 1, Block
25, of the original Rexburg Townsite and running
thence South 100 feet along the west boundary line
of said Lot 1, thence East 198 feet along the
north boundary line of the Grantee's land, thence
North 100 feet along the west boundary line of said
Grantee's land, thence West 198 feet along the north
boundary line .of said Lot 1 to the point of beginning;
containing 0.455 of an acre.
Commencing at a point 125 feet North of the.Southeast corner of Lot 1,
Block 7 in the City of Rexburg, Madison County, Idaho, as per the
recorded plat thereof and running thence West 231 feet, thence North
172 feet, thence East 231 feet, thence South 172 feet to the.point of
beginning.
Commencing at the Southeast Corner of Lot 1, Block 7 of the Original Townsite of
Rexburg, Madison County, Idaho, as shown on the recorded plat thereof and
running thence West 81 feet; thence North 125 feet; thence East 81 feet; thence
South 125 feet to the point of beginning.
Commencing at a point 165 feet South and 27 feet East of the Northwest Corner of Lot 1 in Block 38 of the Original Rexburg Townsite, Madison County, Idaho, as per the recorded plat 8
inches; thence West 138 feet; thence North 164 feet 8 inches to the point of beginning.
